Don’t Be A Victim Of Summer Crimes

Dallas, 05/04/2017 /SubmitPressRelease123/

Most people enjoy the summer. Warm temperatures and much-needed vacations are almost universally loved.

However, summer is not without its downsides. Certain crimes, including household crimes, peak in the summer months. To avoid being a victim of a summer crime, keep the following tips in mind.

Lock Your Car

When the weather heats up, you might be tempted to leave your windows down. However, this makes it easier for thieves to gain access to your vehicle, along with any items inside it.

Always lock your vehicle — even if you live in a low-crime area. In many cases, thieves specifically target residential neighborhoods, where residents are less likely to be cautious about leaving a car unlocked in the driveway.

Lock Your Home

You should also secure your doors and windows — especially at night. Household burglaries are highest in the summer months, when the weather is warm. With children running in and out and guests coming over for picnics and get-togethers, it can be easy to overlook an open window or unlocked door. Make a habit of going around your house each night before bed and checking all of your doors and windows.

Don’t Advertise Vacations on Social Media

Social media is a big part of everyday life. Before you post that photo of yourself reenacting scenes from “Titanic” on the cruise ship, remember that it might not just be your friends who see your photos.

Just because your account is private or restricted to online friends only doesn’t mean the photos can’t find their way into the wrong hands — or the wrong computer screen. Savvy thieves deliberately monitor the internet to see which homeowners are away from their houses during typical vacation months.

Don’t Carry a Lot of Cash on Vacation

Whether you’re vacationing across the world or right around the corner from your home, be careful about how much cash you carry while you’re taking in the sights and relaxing by the beach.

Pickpocketing is a serious problem in most major cities. Carry just as much cash as you need to pay for food and items you need for the day. Even better, use a bank card. If your card is stolen or lost, you can contact your bank right away to have them shut it down, which prevents thieves from accessing your account.

Enjoy the Summer and Stay Safe

With a little caution and some common sense, you can enjoy the summer without worrying about being a victim of crime. If you have been wrongfully charged with a crime in Texas, speak to an experienced Texas criminal defense lawyer as soon as possible.

Pedestrian Fatalities Increase Says Philadelphia Pedestrian Accident Lawyer

Philadelphia, PA, USA, 05/04/2017 /SubmitPressRelease123/

You see it every day on Philadelphia sidewalks and streets. Drivers distracted by their smart phones and pedestrians not paying attention to where they’re walking because they’re too focused on their smart phones. It’s becoming the worst of both worlds warns Philadelphia pedestrian accident lawyer Rand Spear.

Walking is becoming more popular, especially now that the weather is improving and summer’s heat hasn’t hit yet. More of us are trying to live healthier lives by getting more exercise and for many it’s just simpler, easier and cheaper to walk than rely on other means of transportation. If you’re walking on city streets the benefits of walking come at a potential cost, the risk of being struck by a vehicle, adds personal injury lawyer Rand Spear.

The Governors Highway Safety Association (GHSA) has released a report showing the number of pedestrians killed in traffic accidents increased 11% last year, to nearly 6,000 people, reports NPR. It’s the biggest single year increase in pedestrian fatalities ever and the highest number of deaths in more than twenty years.

GHSA executive director Jonathan Adkins called the results alarming and “counterintuitive” because more vehicles are equipped with more and better safety devices meant to at least warn, if not prevent, drivers from making mistakes that can cause deadly accidents.

“We’re seeing just the opposite, unfortunately, with a particular spike as it relates to pedestrians and cyclists,” Adkins is quoted as saying. This information was released a month after the National Safety Council (NSC) reported that traffic deaths increased 6% nationwide in 2016.

Maureen Vogel, NSC spokeswoman, stated given traffic deaths increased it shouldn’t be surprising that pedestrian deaths went up too, but what’s unexpected is the increase in pedestrian deaths is nearly twice that of overall traffic accident fatalities. She states because of a better economy more people are driving and taking advantage of low gas prices while technology is taking a toll on those inside and outside vehicles. Distracted drivers and pedestrians are getting themselves in trouble.

Melody Geraci, deputy executive director of the Active Transportation Alliance, a Chicago based organization that advocates for better walking, cycling and public transportation states that after speeding and the failure to yield, distractions are the number three cause of pedestrian fatalities, especially due to electronic devices.

Physics plays the biggest role when it comes to pedestrian deaths. Tremendous force can be brought against a person weighing 200 pounds when struck by a vehicle weighing 4,000 pounds. If a pedestrian is struck by a vehicle going 20 miles an hour, they have about a 10% percent chance of dying, according to Geraci, and if they are hit at 40 miles an hour, they have about an 80% chance of dying.

Other factors are:

<!– [if !supportLists]·
[endif]–>Poor visibility (74% of pedestrian fatalities happen at night)

<!– [if !supportLists]·
[endif]–>Jaywalking (72% of the pedestrians killed were not crossing at intersections) and

<!– [if !supportLists]·
[endif]–>Alcohol use by both drivers and pedestrians (15% of pedestrians killed each year are hit by a drunk driver and more than twice as many, or 34% of pedestrians, killed were legally drunk).

Saving more pedestrian lives is no mystery. Drivers need to focus on driving and obey the rules of the road. Pedestrians need to use care when walking, especially at night and while crossing streets. The challenge is for all of us not to take our safety, and the safety of others, for granted.

But for even the safest of pedestrians, accidents still happen. Drivers don’t pay attention, mistakes are made and the result can be serious injuries and even deaths to those who are walking in the wrong place at the wrong time through no fault of their own. If you or a loved one has been injured as a pedestrian or a car or truck crash caused by a negligent driver, call Philadelphia and New Jersey pedestrian accident lawyer  Rand Spear today at 877-GET-RAND.

Dallas Criminal Lawyer On What Evidence The Defense Gets To See Before Trial

Dallas, TX, USA, 05/04/2017 /SubmitPressRelease123/

In criminal cases, in state or federal court, the government has to turn over evidence before trial.  Usually, it consists of police reports and the documents and physical evidence (like photographs, videotapes, objects, phone records, and test results) that the government plans to introduce as evidence in court at trial.  In federal court, you usually get an investigating agent’s memos of interviews with witnesses during the investigation, says Dallas criminal lawyer John Helms.

Criminal defense lawyers show these materials to the client, and the lawyer and defendant go over them. The evidence that the government produces often shows how strong or weak the government’s case would be at trial. But does it include all of the evidence that will come in at trial?

A lot of criminal defendants want to believe that a trial will consist only of the information the government has turned over. They sometimes think that they can win at trial based on the assumption that there will be no other evidence. But that is not a safe assumption.

First of all, it is not true the government is required to turn over all of the evidence it will use at trial. The government is NOT required, for example, to tell the defendant what every witness will say on the witness stand. Even if the prosecutor follows common federal court practice and turns over the investigating agent’s witness interview memos, the law does not say that the witness can only testify about things that are in the interview memo.

The government is also not required to say HOW the government will use the evidence it does turn over. For example, the government may turn over phone records, but the government may not be required to tell the defendant what they will use the phone records to prove. If the phone records show a flurry of phone calls to and from the defendant just before and after a drug transaction, the defense may have to figure that out for themselves.

It takes an experienced criminal defense attorney to fill in these blanks, but even the best lawyers cannot anticipate everything that will happen at trial. The best defense lawyers know that there will be unexpected testimony and surprises at every trial, and they take that into account in evaluating the case as well as preparing for trial. There are almost never depositions in criminal cases, and many witnesses will not talk to the defense before trial, so a defense lawyer may not have a great sense of how the witness will come across during testimony. Sometimes, a witness turns out to be more credible than you expected.  Sometimes, a witness might be less certain about what really happened or admit to having a poor memory of the event. Good lawyers know trials involve uncertainty. They have to be able to adjust their approach and strategy when there are surprises.

If you or your loved one is accused of a crime, you should never assume that you can just look at the evidence the government produces and know how the trial will come out. One of the reasons to hire a top-notch criminal defense lawyer is because they have the experience it takes to anticipate, as well as anyone can, what could and probably will happen. In this way, they can give the best advice before trial and do the best possible job in trial.

If you, a family member or someone you know has been charged with a crime in the Dallas area, contact Dallas criminal lawyer John Helms at (214) 666-8010 or fill out the online contact form. You can discuss your case, how the law may apply and your best legal options to protect your rights and freedom.

Air Quality Week – Learn About Cities with the Worst Air Pollution in the U.S.

Riverdale, NJ, 05/04/2017 /SubmitPressRelease123/

When you think about air pollution, you probably think about clouds of smoke or soot, or vehicle exhaust, but do you also consider whether you are living in a city with the worst air pollution in the country? That is an important question when it comes to long-term health, which is why it’s so important to understand what pollution means and why it could affect your well-being.

“Well for years, we have sounded the alarm about the importance of clean air,” stated Kevin Wood, Camfil USA Vice President Sales & Marketing. “There is a direct correlation between the level of air quality and some ailments that are related to breathing, and can be worse in cities with the worst air pollution.”

You probably based where you chose to live on several factors such as job opportunities, standard of living, weather and proximity to other members of your family.

But it’s unlikely that you factored in the level of pollution as one of your major considerations, because the truth is, despite the fact that pollution levels are killing millions throughout the world, the issue has not become as urgent as it should be.

And that’s partly because a lot of people believe that as long as they limit the time they spend outdoors, they can avoid the worst aspects of pollution.

But the truth is that outdoor pollution has a huge effect on indoor air quality (IAQ), which is why it’s so important to know what cities suffer from the worst air pollution.

Outdoor Pollution Worsens Indoor Air Quality

According to a fact sheet on the University of Kentucky Occupational Health and Safety website, outdoor pollution is one of the major factors that affects IAQ.

Per the fact sheet, (1) polluted outdoor air from sources such as vehicle exhaust, pollen and industrial pollutants have a major effect on IAQ.

In addition, emissions from sources such as dumpsters, loading docks and factories, as well as soil gas from radon sources and pesticides can also worsen IAQ.

And according to an article in Care2: (2)

“Scientific evidence indicates that indoor air can be more seriously polluted than the outdoor air in even the largest and most industrialized cities. Other studies indicate that people spend approximately 90 percent of their time indoors. The math isn’t so great – for many people health risks may be greater due to indoor air pollution rather than outdoor pollution.”

And that’s the problem when people try to escape poor outdoor air conditions by believing in error that they are safe at home, an office or in some other enclosed area.

Thus, knowing the air pollution levels in some of the biggest cities in the U.S. can provide you with actionable information to help you determine how air quality may be affecting your health or the health of someone in your family.

Top 10 Cities with the Worst Air Pollution

According to an article on, although the overall outdoor air quality has improved in the U.S., (3) the air is still harmful enough to exacerbate respiratory issues such as asthma, per the American Lung Association.

The article ranked the 10 cities in the U.S. with the largest level of particulate matter (PM) per year. PM is a numeric value from a program originally created by the US Environmental Protection Agency to provide values to the public so they could understand possibly dangerous outside air conditions. When levels are too high, newspapers, local radio and television voice warnings to vulnerable people; those with asthma or other respiratory problems where increased activity during these periods of high contaminant levels could impair their health. PM is classified in three levels, PM10, PM2.5 and PM1. Health experts have determined that the most harmful PM values are those at PM2.5, which includes particles 2.5 microns or smaller, which are microscopic, but capable of being swallowed or inhaled.

Once these particulates enter a person’s body, they can irritate the lungs and throat and cause respiratory problems.

The 10 cities that ranked as having the worst air pollution were:

Bakersfield, CA
Visalia-Porterville-Hanford, CA
Fresno-Madera, CA
Los Angeles, CA
El Centro, CA
San Jose/San Francisco/Oakland, CA
Modesto-Merced, CA
Pittsburgh-New Castle-Weirton, Pennsylvania, Ohio, W. Virginia
Harrisburg-York-Lebanon, PA
Louisville-Jefferson County-Elizabethtown-Madison, KY, Indiana

It’s no surprise that so many cities on the worst pollution list are in California, as the state has always had problems with poor air quality.

One of the reasons Bakersfield leads the nation as having the worst air pollution is that it’s located in the heart of the San Joaquin Valley, which is the source of a “lot of dust, pesticides, and fertilizers.”

In fact, the Bakersfield area ranks first in the nation in the level of annual particulates as well as 24-hour peak averages.

And with a population of more than 18 million, Los Angeles has the highest level of ozone and ranks fourth for yearly level of harmful particulates.

What’s clear about many of the cities on this list is that they are in large, urban areas with common sources of pollution such as vehicle exhaust and factory emissions.

Commercial Trucks Can Hit & Run Too Says Boca Truck Accident Lawyer Joe Osborne

Boca Raton, FL, USA, 05/03/2017 /SubmitPressRelease123/

If you imagine yourself getting involved in a hit and run accident, you may think about a speeding car driven by a teen distracted by a smart phone or a car driven by someone who had too many drinks after work. As hazardous as those kinds of situations can be, it could be far worse if that out of control vehicle is a tractor-trailer says Boca truck accident lawyer Joe Osborne.

Such a situation turned out to be fatal for a 71 year old Orlando resident who was killed on U.S. Highway 192 outside of St. Cloud last month, according to the Florida Highway Patrol, reports the Sun Sentinel. Troopers reported the tractor-trailer turned in front of a sedan heading east. The front of the car hit the side of the tractor-trailer and the truck driver never stopped. The truck and trailer were later located by police.

The man driving the car, whose identity wasn’t released, died at the scene. An Osceola County deputy recognized the tractor-trailer when he saw it at a gas station in the St. Cloud area. The deputy followed the tractor-trailer until troopers could pull over the driver. The newspaper reported the Florida Highway Patrol was collecting evidence and talking to a person of interest, added personal injury lawyer Osborne.

Commercial truck hit and run accidents are not uncommon.

Alo last month a man died after a tractor-trailer slammed into his car then kept going near the entrance of the George Washington Bridge in New York City, reports WPIX. He was in the car with two passengers on the westbound Cross Bronx Expressway at the time of the accident. The driver was later stopped at a rest stop in New Jersey.

Another semi-truck truck struck and killed a pedestrian in Brooklyn, New York, in January. She was crossing a street when she was hit by the truck, according to the New York Post. Police later located the driver and were investigating if the driver was aware the pedestrian was struck.

A pedestrian was killed in Fort Lauderdale in a hit and run accident involving a tractor-trailer in 2014, reports the Sun Sentinel. David Howard Richter was struck along the 2000 block of West Sunrise Boulevard as the truck driver exited Interstate 95 to go westbound on Sunrise Boulevard.

Why would a commercial truck driver leave the scene of an accident?

The driver may not realize an accident happened. A truck driver may not have known a pedestrian was struck by a part of the truck or trailer. The driver may also be too fatigued or impaired by drugs or alcohol to know what’s going on.

A truck driver may have his or her commercial driver’s license suspended, revoked or canceled if he or she is at fault in an accident, depending on the facts of the situation and prior traffic violations or arrests. Such a driver may want to flee the scene in hopes of maintaining his or her ability to drive and earn an income.

No matter why the truck left the accident, if you or a loved one suffered an injury caused in a hit and run accident involving a tractor-trailer, contact Boca truck accident lawyer Joe Osborne at (561) 800-4011 or fill out this online contact form. You can discuss your case, how the law may apply and your best legal options to protect your rights and obtain compensation for your injuries.

Philadelphia Personal Injury Lawyer Discusses Big Box Store Injuries

Philadelphia, 05/03/2017 /SubmitPressRelease123/

Also known as “superstores” or “supercenters,” big box stores are large retailers with a layout that literally looks like a giant box from above. Common big box stores include Walmart and Target. They offer a staggering variety of products, and many now include entire grocery stores inside.

These stores are convenient, but they can also be dangerous. Products can slip from the shelves and burst open on the floor, causing a slip and fall hazard. Items can also fall from upper shelves and cause serious injury. If you’ve been injured in a big box store, it’s important to speak to a personal injury lawyer right away.

Slips and Falls in Big Box Stores

This probably won’t surprise many people, but Walmart is the world’s largest retailer. It’s almost impossible to drive anywhere in the U.S. and not see a Walmart store. With so many stores, however, injuries are inevitable. According to one report, the retail giant faces up to 5,000 lawsuits every year.

And with so many items on the shelves, spills are inevitable. Slippery liquid on the floor is a hazard — whether it’s laundry detergent, milk, or water. Unfortunately, these stores are so massive, it sometimes takes workers a while to notice that a spill has occurred.

Philadelphia personal injury lawyer Rand Spear explains, “Big box retailers almost always have their own company protocol for handling a slip and fall incident or other type of injury. If you slip and fall in a big box store, be polite, but be careful not to make any statements about the nature of your injuries. Don’t self-diagnose on the spot. Only a doctor can determine how badly you’re hurt. Any statement you make to employees on the scene could be used against you in a personal injury case down the road.”

Falling Objects in Big Box Stores

Getting struck by a falling object is terrifying. It comes out of nowhere, and you have absolutely no time to prepare for it. Big box retail stores often keep extra merchandise stocked on upper shelves. However, this merchandise can shift and plummet to the ground — or on a customer’s head.

If you’re injured by a falling object in a big box store, get medical help right away. This type of injury can leave an individual with serious neck, spine, and back injuries. Seek emergency medical help, then speak to an attorney about protecting your important legal rights.

Contact a Philadelphia Personal Injury Lawyer Today

Big box stores are owned by massive corporations, and you can be sure they have an army of lawyers at their disposal. However, you shouldn’t back down if you’ve been hurt in a large retail store or supercenter. Fight back and protect your rights. Discuss the next steps in your case with Philadelphia and New Jersey personal injury lawyer.  Demand Rand Spear today at 877-GET-RAND.

Atlanta Truck Accident Lawyer Discusses: Is Uber Coming To A Semi Near You?

Dallas, 05/03/2017 /SubmitPressRelease123/

Founded in 2009, Uber works by allowing regular people with reliable vehicles to connect with individuals who need a taxi service. The Uber app lets users leave reviews for drivers and even pay with their credit card, so no money ever changes hands.

Uber has become so popular, it’s now being adapted to the world of trucking, which brings us to its spin off company, Uber Freight that purchased another business called Otto, according to a Popular Science report. The alarming aspect about Otto is it operates a fleet of autonomous trucks.

This new Uber company allows carriers to receive and transport packages. It also lets shippers connect with carriers directly to send their items — all without extensive contracts, broker fees, and red tape frequently involved in traditional shipping arrangements with trucking companies.

Where are Self-Driving Trucks Going?

In 2016, an autonomous Otto truck made a 125-mile journey across Colorado to deliver a load of beer. Amazon is apparently working to launch its own version of the Uber Freight business. Currently, Uber Freight is in a testing stage with plans to fully launch in 2017. Although Amazon hasn’t said when it will debut its truck driving service, the media has speculated that it will likely launch around the same time as Uber Freight.

Also in 2016, a convoy of semi-autonomous trucks trekked 1,200 miles across Europe, hauling freight in a test drive to determine how the semis handled their route. Trucking experts say fully automated semis are still a long way off; however, driverless trucks are definitely not science fiction.

“There have been several accidents involving autonomous vehicles. Over the past year, a test driver in an autonomous vehicle was killed when the vehicle’s computer system couldn’t distinguish the side of a semi-truck trailer from the sky,” said Amy Witherite, co-founder and principal of personal injury law firm, Eberstein Witherite. “These kinds of accidents demonstrate why the idea of driverless semis is concerning. A semi-truck can weigh up to 80,000 pounds. With a computer in charge, there is a potential for serious accidents if the computer makes an error a human driver would recognize and correct.”

On the other hand, proponents of autonomous semi-trucks point out that human error is responsible for the majority of trucking accidents. Distractions and fatigue are two of the top causes of truck accidents. By removing the need for sleep, and the temptation to glance at an email or text, driverless trucking advocates say the industry could reduce the number of serious and fatal semi-truck accidents.

If you have been injured in a semi-truck accident, you should discuss your case with an experienced Georgia truck accident lawyer right away.
