Don’t Carry a Lot of Cash on Vacation

Whether you’re vacationing across the world or right around the corner from your home, be careful about how much cash you carry while you’re taking in the sights and relaxing by the beach.

Pickpocketing is a serious problem in most major cities. Carry just as much cash as you need to pay for food and items you need for the day. Even better, use a bank card. If your card is stolen or lost, you can contact your bank right away to have them shut it down, which prevents thieves from accessing your account.

Pedestrian Fatalities Increase Says Philadelphia Pedestrian Accident Lawyer

GHSA executive director Jonathan Adkins called the results alarming and “counterintuitive” because more vehicles are equipped with more and better safety devices meant to at least warn, if not prevent, drivers from making mistakes that can cause deadly accidents.

“We’re seeing just the opposite, unfortunately, with a particular spike as it relates to pedestrians and cyclists,” Adkins is quoted as saying. This information was released a month after the National Safety Council (NSC) reported that traffic deaths increased 6% nationwide in 2016.

Maureen Vogel, NSC spokeswoman, stated given traffic deaths increased it shouldn’t be surprising that pedestrian deaths went up too, but what’s unexpected is the increase in pedestrian deaths is nearly twice that of overall traffic accident fatalities. She states because of a better economy more people are driving and taking advantage of low gas prices while technology is taking a toll on those inside and outside vehicles. Distracted drivers and pedestrians are getting themselves in trouble.

Melody Geraci, deputy executive director of the Active Transportation Alliance, a Chicago based organization that advocates for better walking, cycling and public transportation states that after speeding and the failure to yield, distractions are the number three cause of pedestrian fatalities, especially due to electronic devices.

Physics plays the biggest role when it comes to pedestrian deaths. Tremendous force can be brought against a person weighing 200 pounds when struck by a vehicle weighing 4,000 pounds. If a pedestrian is struck by a vehicle going 20 miles an hour, they have about a 10% percent chance of dying, according to Geraci, and if they are hit at 40 miles an hour, they have about an 80% chance of dying.

Dallas Criminal Lawyer On What Evidence The Defense Gets To See Before Trial

In criminal cases, in state or federal court, the government has to turn over evidence before trial.  Usually, it consists of police reports and the documents and physical evidence (like photographs, videotapes, objects, phone records, and test results) that the government plans to introduce as evidence in court at trial.  In federal court, you usually get an investigating agent’s memos of interviews with witnesses during the investigation, says Dallas criminal lawyer John Helms.

Criminal defense lawyers show these materials to the client, and the lawyer and defendant go over them. The evidence that the government produces often shows how strong or weak the government’s case would be at trial. But does it include all of the evidence that will come in at trial?

A lot of criminal defendants want to believe that a trial will consist only of the information the government has turned over. They sometimes think that they can win at trial based on the assumption that there will be no other evidence. But that is not a safe assumption.

First of all, it is not true the government is required to turn over all of the evidence it will use at trial. The government is NOT required, for example, to tell the defendant what every witness will say on the witness stand. Even if the prosecutor follows common federal court practice and turns over the investigating agent’s witness interview memos, the law does not say that the witness can only testify about things that are in the interview memo.

The government is also not required to say HOW the government will use the evidence it does turn over. For example, the government may turn over phone records, but the government may not be required to tell the defendant what they will use the phone records to prove. If the phone records show a flurry of phone calls to and from the defendant just before and after a drug transaction, the defense may have to figure that out for themselves.

It takes an experienced criminal defense attorney to fill in these blanks, but even the best lawyers cannot anticipate everything that will happen at trial. The best defense lawyers know that there will be unexpected testimony and surprises at every trial, and they take that into account in evaluating the case as well as preparing for trial. There are almost never depositions in criminal cases, and many witnesses will not talk to the defense before trial, so a defense lawyer may not have a great sense of how the witness will come across during testimony. Sometimes, a witness turns out to be more credible than you expected.  Sometimes, a witness might be less certain about what really happened or admit to having a poor memory of the event. Good lawyers know trials involve uncertainty. They have to be able to adjust their approach and strategy when there are surprises.

And that’s the problem when people try to escape poor outdoor air conditions by believing in error that they are safe at home, an office or in some other enclosed area.

Top 10 Cities with the Worst Air Pollution

According to an article on Health.com, although the overall outdoor air quality has improved in the U.S., (3) the air is still harmful enough to exacerbate respiratory issues such as asthma, per the American Lung Association.

The article ranked the 10 cities in the U.S. with the largest level of particulate matter (PM) per year. PM is a numeric value from a program originally created by the US Environmental Protection Agency to provide values to the public so they could understand possibly dangerous outside air conditions. When levels are too high, newspapers, local radio and television voice warnings to vulnerable people; those with asthma or other respiratory problems where increased activity during these periods of high contaminant levels could impair their health. PM is classified in three levels, PM10, PM2.5 and PM1. Health experts have determined that the most harmful PM values are those at PM2.5, which includes particles 2.5 microns or smaller, which are microscopic, but capable of being swallowed or inhaled.

Once these particulates enter a person’s body, they can irritate the lungs and throat and cause respiratory problems.

It’s no surprise that so many cities on the worst pollution list are in California, as the state has always had problems with poor air quality.

One of the reasons Bakersfield leads the nation as having the worst air pollution is that it’s located in the heart of the San Joaquin Valley, which is the source of a “lot of dust, pesticides, and fertilizers.”

In fact, the Bakersfield area ranks first in the nation in the level of annual particulates as well as 24-hour peak averages.

And with a population of more than 18 million, Los Angeles has the highest level of ozone and ranks fourth for yearly level of harmful particulates.

What’s clear about many of the cities on this list is that they are in large, urban areas with common sources of pollution such as vehicle exhaust and factory emissions.

Commercial Trucks Can Hit & Run Too Says Boca Truck Accident Lawyer Joe Osborne

The deputy followed the tractor-trailer until troopers could pull over the driver. Alo last month a man died after a tractor-trailer slammed into his car then kept going near the entrance of the George Washington Bridge in New York City, reports WPIX. He was in the car with two passengers on the westbound Cross Bronx Expressway at the time of the accident. The driver was later stopped at a rest stop in New Jersey.

Another semi-truck truck struck and killed a pedestrian in Brooklyn, New York, in January. She was crossing a street when she was hit by the truck, according to the New York Post. Police later located the driver and were investigating if the driver was aware the pedestrian was struck.

A pedestrian was killed in Fort Lauderdale in a hit and run accident involving a tractor-trailer in 2014, reports the Sun Sentinel. David Howard Richter was struck along the 2000 block of West Sunrise Boulevard as the truck driver exited Interstate 95 to go westbound on Sunrise Boulevard.

Atlanta Truck Accident Lawyer Discusses: Is Uber Coming To A Semi Near You?

This new Uber company allows carriers to receive and transport packages. It also lets shippers connect with carriers directly to send their items — all without extensive contracts, broker fees, and red tape frequently involved in traditional shipping arrangements with trucking companies.

Where are Self-Driving Trucks Going?

In 2016, an autonomous Otto truck made a 125-mile journey across Colorado to deliver a load of beer. Amazon is apparently working to launch its own version of the Uber Freight business. Currently, Uber Freight is in a testing stage with plans to fully launch in 2017. Although Amazon hasn’t said when it will debut its truck driving service, the media has speculated that it will likely launch around the same time as Uber Freight.

Also in 2016, a convoy of semi-autonomous trucks trekked 1,200 miles across Europe, hauling freight in a test drive to determine how the semis handled their route. Trucking experts say fully automated semis are still a long way off; however, driverless trucks are definitely not science fiction.

“There have been several accidents involving autonomous vehicles. Over the past year, a test driver in an autonomous vehicle was killed when the vehicle’s computer system couldn’t distinguish the side of a semi-truck trailer from the sky,” said Amy Witherite, co-founder and principal of personal injury law firm, Eberstein Witherite. “These kinds of accidents demonstrate why the idea of driverless semis is concerning. A semi-truck can weigh up to 80,000 pounds. With a computer in charge, there is a potential for serious accidents if the computer makes an error a human driver would recognize and correct.”
