Philadelphia Dog Bite Injury Lawyer Discusses PA As A Top State For Dog Bites

Philadelphia, 05/02/2017 /SubmitPressRelease123/

A new report released by State Farm Insurance reveals the top states for dog bites. Unfortunately, Pennsylvania makes the list. New Jersey’s neighbor, New York, also tops the list of the states with the highest number of dog bites. The report also features some alarming statistics about dog bite cases, adds Rand Spear New Jersey and Philadelphia dog bite lawyer.

Stats from the State Farm Dog Bite Report

According to the report, State Farm has seen a 15 percent jump in dog bite claims in just a one-year period. In 2016, State Farm said it paid out over $121 million for over 3,600 dog bite claims.

The report also lists the top 10 states for dog-related injury claims:

California – 433 claims
Illinois – 323 claims
Ohio – 211 claims
Pennsylvania – 200 claims
Texas – 168 claims
Michigan – 167 claims
New York – 156 claims
Indiana – 137 claims
Georgia – 125 claims
Minnesota – 122 claims

Tips for Staying Safe Around Dogs

The report also offers advice from a canine expert on how to stay safe around dogs. Tips include:

Familiarize yourself with canine “body language” – Dog expressions and behaviors aren’t always the same as the expressions and reactions humans use. For example, a dog yawning may not be a sign of tiredness. Instead, it’s usually an indication that a dog is annoyed.
Give dogs plenty of space – Animals can feel threatened when they’re crowded. Let a dog choose to be near you — not the other way around.
Treat dogs humanely – Dogs that are well treated are less likely to lash out. Never use physical punishment, pain, or fear as a training method.

Dog trainers point out that 65 percent of American households have a dog. If you’re a dog owner, it’s important to be a responsible one. Invest in obedience training, and make sure that any children in your household or family know how to safely interact with your dog. Parents of young children should also take time to teach their kids about dog safety — something that’s important regardless of whether their household has a dog.

Rand Spear a Philadelphia dog bite lawyer explains, “Many people treat their dogs like family members. Dogs may be ‘man’s best friend,’ but they are still animals. They have instincts, and when they’re frightened or in pain, they react instinctively. Responsible dog owners always make sure that their pets are properly trained and kept on a leash or inside a closed fence when they’re outside.”

Overpass Scene Of Several Accidents Says Boca Truck Accident Lawyer Joe Osborne

x

Boca Raton, FL, USA, 05/02/2017 /SubmitPressRelease123/

Earlier this month a tragedy took place in Boca Raton. A tow truck driver, while trying to secure a crashed tractor trailer, fell 30 feet to his death from an Interstate 95 overpass. The tractor trailer overturned at an exit ramp notorious for truck accidents. Boca truck accident lawyer Joe Osborne says often these types of accidents are caused by negligent truck drivers.

There have been at least six major wrecks in the past five years near the Peninsula Corp. A Drive overpass that leads to Congress Avenue in Boca Raton, reports the Sun Sentinel.

According to the article, “Drivers just aren’t slowing down when they leave the interstate,” (Florida Department of Transportation) FDOT Public Information Director Barbara Kelleher said….“They’re not adhering to the signs and pavement markings or slowing down to make the turns safely.”

The truck left southbound I-95 when it failed to turn right, struck a concrete center median, veered left and overturned on its right side, resting on the bridge wall.

Richard Randolph, 69, from West Boca, who worked for Emerald Towing in Pompano Beach, went to the scene where he stepped over the bridge wall, onto a concrete maintenance platform on the outside of the overpass before falling off the edge of the overpass. It’s believed he was trying to secure the trailer.

Randolph planned to retire in November when he turned 70 and move with his wife Judy to northern Florida. The two have ten children and 23 grandchildren.

The truck driver, Adrian Figueredo of Miami, was evaluated at the scene but not taken to the hospital. He was cited for fatigue, driving beyond the eleven hour limit in a fourteen hour period mandated for commercial truck drivers as well as failing to negotiate a right turn.

In August of last year a tractor trailer broke through the concrete barrier on the overpass and its cab hung above motorists traveling on I-95. The driver stated he thought he was entering an express lane, not an off-ramp, and was traveling about 65 mph at the time of the accident, reports WPTV.

Last March a tractor trailer crash occurred on Congress Avenue, closing the entrance ramps to I-95 in both directions for several hours, according to WPTV. Police reported the semi truck rear-ended a sedan as it was exiting southbound I-95 sending the sedan across a median. The truck hit the wall near the I-95 entrance ramp, preventing it from falling over the edge. The truck driver was cited for careless driving along with logbook and commercial driver’s license violations.

FDOT plans to paint lane pavement with “exit lane only” messages and turn arrows by this summer. Signs will also be posted warning drivers to slow down as they are approaching a stoplight and the turn onto Peninsula Corp. Drive. Though signs can help prevent accidents they won’t do any good if truck drivers are too tired to notice them or obey them.

If you or a loved one have suffered an injury caused by an accident involving a tractor trailer, contact Boca truck accident lawyer Joe Osborne at (561) 800-4011 or fill out this online contact form. You can discuss your case, how the law may apply and your best legal options to protect your rights and obtain compensation for your injuries.

How A Patent Lawyer Can Protect Your Invention

Dallas, Texas, United States, 05/02/2017 /SubmitPressRelease123/

A good patent lawyer will be able to help you determine whether your invention can be protected by registration with the U.S. Patent & Trademark Office (USPTO). As part of the process, you’ll learn the type of patent you’ll want to get to for your intellectual property.

What Is A U.S. Patent?

If the USPTO ultimately determines your invention a “new and useful process, machine, article of manufacture, or composition of matter, or any new and useful improvement thereof,” then the federal government will grant you the exclusive right to make, use or sell your intellectual property for 14 to 20 years, depending upon the type of patent. If others want to legally use your invention during that time, they have to pay you for the privilege (license) of doing so.

What About A U.S. Provisional Patent?

Like a unicorn, that really doesn’t exist. However, there are some circumstances justifying the need to file a provisional patent application (PPA) for your invention with the USPTO first, especially as the U.S. has now adopted a “First to File” (and no longer a “First to Invent”) patent system, in order to establish priority.

Note that if one files a PPA, it must be “converted” to a regular, non-provisional application within 12 months of filing the PPA, else the PPA is automatically deemed abandoned, i.e. you’ll lose the benefits of filing the provisional app and be statutorily barred from filing the non-provisional application thereafter.

Types of U.S. Patents

Although a provisional patent does not exist (just a PPA), there are 3 types of patents the USPTO can issue depending upon what you’ve invented. Your Registered Patent Attorney will be able to identify the kind of patent you should seek and prepare the application for the USPTO to examine.

This may be the most critical part of a patent: the patent application!

It’s the properly drafted application that can maximize your property and legal rights.

Patent types include:

• Utility Patents
• Design Patents
• Plant Patents

Most patents are utility patents. In rare circumstances, a proposed invention may qualify for more than one type of patent, and/or qualify for copyright protection and/or trademark protection. A Registered Patent Attorney can help.

Why You Should Take Photos After A Truck Accident

Dallas, 05/01/2017 /SubmitPressRelease123/

Although smartphones can be a distraction behind the wheel, they can also be put to good use after a car wreck or truck wreck.

If you’re like the 77 percent of Americans that own a smartphone, according to Pew Research, you are learning to balance having one in the car while striking a balance of safety and security behind the wheel.

In the world of personal injury law, we believe smartphones can also be put to good use after an accident — especially if you’re involved in an accident with a semi-truck. “While it’s important to take photos following a semi-truck accident, you should only do so if your health permits it,” says Amy Witherite, Eberstein Witherite co-founder and principal. “If you’re injured in the crash, don’t compromise your well-being or your safety in an effort to take pictures of the scene.”

Here are four reasons why you should use your phone’s camera to take pictures after a tractor-trailer collision:

Preserve Important Evidence

The reality is that motor vehicle accident scenes take place outdoors. Even just one hard rainfall can wash away important evidence before investigators can get to it. Also, police must work quickly to clear debris from the road to prevent other motorists from hitting it. When you take photos immediately following an accident, the scene where your car wreck or truck wreck took place is forever preserved in the photographs.

Get Accurate Photos

As the saying goes, “a picture is worth a thousand words.” Photographic evidence of any motor vehicle accident is compelling because it gives people a real-life visual of what happened. When a person reads an account of a crash, they’re forced to imagine what it looked like at the time. With pictures, however, that guesswork goes away. The photos can be a powerful tool for any personal injury lawyer in a settlement or a trial.

Get Evidence of the Surroundings and Environment

In many cases, weather or specific road conditions play a role in a car wreck, truck wreck, or even a large semi-truck crash. After an accident, it’s important to take photos of every vehicle involved, as well as the road conditions and any other surrounding conditions that may have contributed to the crash. For example, a sharp curve in the road could factor into why a semi jackknifed or lost control. In these cases, it’s critical to preserve evidence of the conditions surrounding the accident.

Photograph Injuries

In addition to taking photos of the vehicles, the road, and the weather, you should also use your camera to photograph your own injuries following the accident. Also be sure to continue taking pictures for several days after the accident, as many injuries continue to show worsening symptoms as time passes. For example, bruises may actually get worse in the days following an accident.

If you or a loved one has been injured in any motor vehicle accident, you may be entitled to damages for your injuries or losses. Don’t wait to speak to an attorney about your rights. Call an experienced Texas truck accident lawyer right away to discuss the next steps in your case.

4 Tips After A Car Accident – Explained By Philadelphia Car Accident Lawyer

Philadelphia, 05/01/2017 /SubmitPressRelease123/

“Exchange insurance information.” It’s something all drivers know they’re supposed to do immediately following a car accident. As long as you’re not too injured to do so, you should always get the other driver’s insurance info., says Rand Spear Philadelphia accident lawyer. But what happens if the other driver simply refuses to hand the information over? Is your car accident case a lost cause?

Not so fast. If another motorist refuses to disclose their insurance information, there are several steps you should take:

Don’t Get Into a Confrontation

The worst thing you can do is get involved in an altercation with the other driver. In many cases, people are upset and even angry after a collision. If the other driver is too agitated to hand over their insurance details, stay calm. Your safety should be your top priority. Don’t compromise it by insisting that the other driver disclose their insurance info.

If the other driver speeds off after the accident without stopping, do not chase after them in your vehicle. This puts you in an extremely dangerous situation that can lead to serious injuries. Let the police handle tracking down a hit and run driver. Pennsylvania law makes it illegal for motorists to leave the scene of a car accident involving injury or death. You can be sure the police will be vigilant about tracking down the person who fled the accident scene.

Contact the Police

As soon as you can safely do so, contact the police. Let them know that you’ve been in a car accident and that the other motorist refused to give you their insurance information.

Write Down the Car’s License Plate Number

You should also write down the other driver’s license plate number as soon as possible. If you delay, there’s a chance you could forget it. The police can use this information to quickly track and locate the other driver. The other motorist might not want to hand over their insurance information to you, but they won’t have any choice but to disclose it to the police.

Tip: If you have a smartphone, use your phone’s camera to snap a quick photo of the other driver’s license plate — just make sure you do so discreetly in the event the other driver is being belligerent or uncooperative.

Call a Car Accident Lawyer

Finally, you should call an experienced car accident lawyer as soon as you can. PA car accident lawyer Rand Spear explains, “Experienced car accident attorneys know how to find defendants who try to sidestep their obligations. Your lawyer will work with you and the authorities to find the individual responsible for your accident.”
