Laws That Truckers Have To Follow

Once you pass your driver’s test and get your license, the only road rules you have to think about are the traffic laws that govern all regular motorists.

For truckers, however, the rules are more complicated. The safety of everyone on the road depends on truck drivers complying with the federal and state regulations that govern commercial vehicles, carriers, and operators.

Special Licensing

Truck operators must pass both a knowledge test and a skills test to obtain their commercial driver’s license (CDL). Once an individual has a CDL, they are also subject to enhanced penalties if they violate traffic laws and drinking and driving laws. Truckers who drive specific types of trucks, such as trucks with double or triple trailers, must also obtain special endorsements before they’re allowed to drive these special vehicles.

Hours-of-Service

Set by the Federal Motor Carrier Safety Administration (FMCSA), federal hours-of-service rules apply to all cargo-carrying commercial trucks in the U.S. regardless of which state they’re driving in. Under the hours-of-service rule, truckers are permitted to drive up to 11 consecutive hours after at least 10 consecutive off-duty hours. Truckers must also log their hours, and a new rule requires them to switch to electronic logbooks starting December 18, 2017.  

Weight and Length Standards

Semi-trucks are subject to weight limits that depend on whether they are a single axle truck or a tandem axle truck. On any interstate highway, the maximum gross vehicle weight for any truck is 80,000 pounds. There are also maximum length standards for tractor-trailers.

Physical Exams

Just like airline pilots, truck drivers must also undergo a physical exam at least once every 24 months. Per FMCSA rules, the exam must be conducted by an authorized examiner. The exam checks for high blood pressure, impaired vision, respiratory conditions, alcohol or drug use, and several other basic health problems that could potentially cause a driver to become impaired while driving.

PROSPER Show Helps FBA Sellers Navigate Pressing Sales Tax Issues

Data gathered by The Capital Forum showed that Amazon third-party sellers who used Fulfillment by Amazon (FBA) failed to pay an estimated $1.9 billion in state sales tax for 2016. The report also showed that less than 6 percent of the top 5,000 FBA sellers are compliant with state tax regulations. PROSPER Show, an annual business conference for Amazon sellers, is helping retailers navigate challenging tax issues to avoid the liability of unpaid sales tax.

After fighting with the states for many years, Amazon now pays sales tax to 42 states for its own direct sales. Amazon, however, takes the position that sales tax for FBA sales is the retailer’s obligation. Unfortunately, retailers often end up with significant sales tax liability because Amazon moves inventory from state to state, often without clear notice. Quickly moving inventory between Amazon’s fulfillment centers in 22 states creates sales tax nexus and triggers the seller’s obligations to collect state sales tax. On the average, sellers have products in seven fulfillment centers during the first month of using FBA and in more than 15 fulfillment centers by the end of a year.

The 2017 PROSPER Show internet marketing conference was held in Las Vegas, Nevada on March 22, featured helpful insights about sales tax nexus including presentations by Richard Cram and Michael Fleming. Whatever your legal issues are, it’s important that you face them: the sooner, the better. More often than not, it happens that the anticipation of having to deal with them is far worse than the consequences you have to endure. Some things to consider about cleaning up your legal issues are:

Ask for help. Whether it’s from a sponsor, a friend or family member, an attorney, or a clergy person, don’t try to do it all alone. A little bit of support goes a long way.
Don’t ignore any legal proceedings. Be sure that you go to all of your court dates. Ignoring them will only make things worse for you in the long run. However, it’s likely that you also have people in your life who feel you can’t be trusted, who are angry with you, and who want nothing to do with you. It’s in dealing with those people that you will have a challenge. Here are some things to think about as you begin trying to restore damaged or lost relationships:

Make amends. Whether you need to make amends for your behavior, for money that you owe, or for hurt you have caused, reach out to the people you have wronged and see how you can make it right. Making amends is more than giving an apology or repaying a debt. It requires a conversation and an explanation. It’s alright to come right out and say, “How can I make this right?” Then, if it is within your ability, do it.
Show, don’t tell. Have you ever thought about how many times you have said you were sorry, but you continued to use or drink? Your loved ones probably don’t want to hear it anymore – they want to see it. The best way to earn back trust is to start being trustworthy. That’s an action, not a statement.
Clean your side of the street. Some people may not want you in their lives again, even when you attempt to make amends. All you can do is take care of your own mess, try to make things right, and then let it go. You cannot make someone else forgive you.
Be patient. Restoring relationships after drug or alcohol addiction takes time. You have to be patient with others in your life. You may feel that you have made significant changes, but others have to see progress before they come around.
Practice acceptance. Whatever the outcome is with your damaged relationships, you have to accept the other person’s decision. It doesn’t mean you have to like it, but you do have to accept it. Remember, it doesn’t mean that they won’t change their mind somewhere down the line.

United’s CEO clearly failed to understand how people would react to the video of a paying customer being roughed up, bloodied, and dragged off a plane screaming. He also tried to defend United’s actions based on the idea that United had the legal right to bump a passenger. The result was a public relations and financial disaster.

As criminal defense lawyers, our duty is to defend our clients. Our clients, though, are often in trouble because they exercised poor judgment. It is very common for those clients to fail to appreciate what they have done and to try to defend their actions. They are often adamant that they did nothing wrong, and they may really believe it. As lawyers, we try to understand our clients’ perspectives and to achieve their objectives. Because we want our clients to trust us and to be happy with our work, there is a temptation to blind ourselves to how our clients’ actions and defense may play with a neutral observer like a judge or jury, says defense attorney Helms.

Lawyers therefore have to understand that, in order to defend our clients successfully, we must give them objective advice about the consequences of trying to justify what they did. This means, first, being able to step back and look at the facts objectively using good judgment. Second, we must gain our clients’ trust by listening to them carefully, understanding their perspective, and convincing them that they will be better off if the advice they get is based on objective reality instead of just what they want to hear. This takes skill and patience, because clients will often react very negatively to their lawyer saying anything they perceive as criticism. They will say things like, “You are my lawyer. You are supposed to fight for me.” They will also argue with their lawyer’s analysis and refuse to try to understand anyone else’s perspective but their own.

Sometimes, it takes a long time and a lot of effort to get a client to understand that they did something wrong and to accept that they can achieve the best outcome by admitting it. I had a civil case recently in which a client took money from his partnership business without telling the other partner. He set up a secret bank account in the partnership’s name and deposited a payment to the partnership into that account. When he came to me to defend the partnership’s lawsuit against him, he had all kinds of excuses about how the other partner had treated him badly and how he had not been paid everything he claimed he was due. He was adamant that he was the real victim. He wanted to fight and show his partner that he could not be pushed around.

It took months, but I was finally able to convince him that what he did was wrong and that he was going to lose at trial. The question was how badly. He was going to have to pay back the money he took, but how much would the jury add on as punitive damages? He believed that the best approach was to try to show that his partner was a bad person so that the jury would not like him and to try to justify what he did. I told him that fighting would be a recipe for disaster because it would just convince the jury that he did not even believe what he did was wrong and that he was just attacking the victim. Like the public reacting to the United CEO’s statements, juries absolutely hate that.

I finally convinced my client that the best strategy was not to attack his partner, to admit up front that what he did was wrong, not to make excuses, and to explain how he has come to understand that his reasons for doing it did not justify his actions. He also sincerely apologized to his partner from the witness stand.  The result was that he avoided what could easily have been a huge verdict against him.

There is no doubt that many cases can and should be fought and won. Good lawyers know when to fight. They also know how to fight hard and intelligently in order to get the best possible outcome. Good lawyers also know how to get the best possible outcome when fighting is a bad idea. These are lessons that United’s CEO has just had to learn the hard way.

As we age it’s common for vision changes to impact our ability to see well in low light, such as during dusk and dawn. An older driver may need more light to see properly and limited lighting conditions can affect depth perception, color perception, contrast sensitivity and peripheral vision.

Avoid unnecessary dangers.

Driver fatigue is far more likely when driving at dusk, dawn or night. Before leaving in the morning get enough sleep. Don’t underestimate the value of sleep. It’s a necessity, not a luxury. Not only will you feel better throughout the day if you’re well rested you’re less likely to get into an accident.

Six Minutes has lots of action and a very quick pace that is very common in the best of thrillers. It’s based on the true story of a deadly crime that took place in a holy Sikh temple. A white supremacist inspired by racist propaganda stormed into the temple, and massacred innocent civilians. The premise of Six Minutes is both entertaining and educational, because it emphasizes the dangers of bigotry, and how one man’s prejudice can kill so many people. This short film is a reflection of our times. The story takes place in modern day America, and shows how Islamophobia can persuade people to give in to the forces of evil that exist in the world. Unfortunately discrimination has become more and more frequent in recent years, especially when it’s being directed against Sikhs, or anyone who looks or happens to be Muslim.

 

Farida’s portrayal of the character Sana is perfect and full of the raw emotion that one can relate to in moments of distress. In the film Sana is Ria’s aunt, and she accompanies Ria and Vicky on their trip to the Sikh temple. The moment that Ria and Vicky arrive a skinhead gets there a few minutes later, and shoots a Muslim couple as well as some Sikhs, who were busy praying inside the temple. In one specific scene Farida channels the feeling of a person trying to do everything in their power to protect an innocent child from harm, through the character Sana. The natural talent that Farida has enables her to act out this climax, of a scene as if she experienced it herself. She is an outstanding actress who is able to amaze and thrill audiences with her very realistic performance, of a woman attempting to save her life, as well as that of her loved ones from a hateful and murderous criminal.

 

The film’s catchy title Six Minutes is in essence a summary of what can happen to a person in such a short time span. In six minutes a person with a racist ideology, and with white power tattoos all over his body can slaughter numerous people, just because of the color of their skin, their religion, or because they’re different.

 

Farida has what it takes to make this successful project shine on the big screen. As a popular actress she will be able to bring her fervent passion for justice to life in the feature film. There is nobody in the entertainment industry more qualified for this role than Farida. In this creative film Farida understood her character’s desires, and was able to accurately play the part of a Sikh woman protecting a young girl, in order to prevent her from becoming the victim of a hate crime.
