Keurig Settlement Over Burn Injuries

In just a few short years, single-serve pod coffeemakers have replaced standard coffee machines in many offices and homes across the country. Recently, however, the Consumer Product Safety Commission (CPSC) announced that Keurig, one of the most popular brands of pod coffee machines, will pay $5.8 million in penalties for failing to report a burn risk it knew about.

CPSC Says Keurig Knew about Defective Coffee Machines

It’s an understatement to say that America is a nation of coffee drinkers. According to Gallup, two-thirds of the country consumes at least one cup each day. One-quarter of the population admits to being addicted, but less than 10 percent of self-professed “coffee addicts” say they’re trying to quit — or even want to.

With so many people drinking coffee, it goes without saying that coffee pots and machines — which reach temperatures hot enough to cause third-degree burns — should function safely.

Unfortunately, there have been multiple reports of consumers being severely burned when their Keurig coffeemaker sprayed hot water out of the machine without warning. According to the CPSC announcement, the company received about 200 reports of people suffering second- and third-degree burns to their hands, faces, and bodies.

The CPSC says that Keurig knew about the injuries but failed to report a defect in its machines. The announcement says that Keurig recalled about 6.6 million MINI Plus brewers manufactured between December 2009 and December 2014.

The company will also pay $5.8 million in penalties. The CPSC announcement says that Keurig’s agreement to pay the penalties does not constitute an admission of the charges leveled against it.

Zimmer Kinectiv Hip Implant Trial Ends In $2 Mil. Verdict For Injured Plaintiff

In what is believed to be the first case involving a Zimmer Kinectiv hip implant system that went to trial, the judge found the defendant responsible for the plaintiff’s injuries, awarding him more than $2 million. After a two-week trial in Albuquerque, New Mexico, the judge found that the hip implant was a defective product and it caused a number of injuries to the plaintiff, Michael Brian McDonald, PhD.

Joseph Osborne, Jr., of Osborne & Associates in Boca Raton, Fla., represents Dr. McDonald, along with other plaintiffs around the country suing hip implant manufacturers due to injuries caused by the devices. “We are very happy for Dr. McDonald and satisfied that our efforts lead to compensation for all the serious medical problems, pain and suffering he needlessly had to endure and will continue to endure,” Osborne says.

Osborne tried the case with Randi McGinn and Allegra Carpenter of McGinn, Carpenter, Montoya & Love, P.A., of Albuquerque, N.M. There are a number of cases filed against Zimmer because alleged defective implants have caused injuries to patients.

In a 27-page decision filed on March 31, New Mexico Judge Nan G. Nash found that,

McDonald was implanted with Zimmer’s M/L Taper Hip Prosthesis with Kinectiv Technology in June 2010. Due to problems with the hip implant another surgery took place in October 2011 to replace it, then a third surgery was needed a month later for another replacement.

McDonald was poisoned by metallic particles (metallosis) from the replacement hip. Tissue in the hip area was so injured it couldn’t be surgically removed and it poses an ongoing threat of infection for McDonald, who his expected to continue to take antibiotics for the rest of his life.

The Zimmer hip replacement system limited McDonald’s functions, caused him pain, infections, multiple surgeries and although he’s currently doing well, another hip replacement surgery may be needed at some point in the future.

A hip implant should not cause metallosis. A small amount of non-toxic corrosion or metal debris may occur with a hip implant, but one that causes enough corrosion or metal debris to cause toxic metal poisoning, as in Dr. McDonald’s case, creates an unreasonable risk of injury.

Zimmer didn’t fully or adequately test the hip implant components implanted in Dr. McDonald and because of the unreasonable risk of metallosis the hip replacement was found to be a defective product and it created an unreasonable risk of harm to McDonald because it allowed the liberation of enough metal debris to injure his hip joint.

The total damages award, which doesn’t include punitive damages, totals $2,027,424.91. It includes:

$1 million for past and future pain and suffering,

$480,000 for lost enjoyment of life, and $462,034 for past and expected future medical expenses.

“Dr. McDonald is just one of thousands of people who have suffered through defective hip implants made by various manufacturers. We have a lot of work to do for all our other clients and look forward to telling their stories and fighting for just compensation for what they’ve had to go through,” Osborne says.

Are Commercial Truck Cameras Making Roads Safer?

The preliminary 2015 fatal truck accident report released by the Federal Motor Carrier Safety Administration (FMCSA) in November 2016 showed an eight percent increase in deaths from 2014 to 2015. It is no surprise, therefore, that the FMCSA is seeking measures that can help lower truck wrecks, which is why truck cameras have become a flashpoint in the commercial trucking industry.

“What you’re seeing is that the government and truck carriers are trying to find a happy medium when it comes to the implementation of technology in the cab of commercial trucks,” stated Truck accident attorney Amy Witherite of Eberstein Witherite, LLP. “So the debate over the effectiveness of in-cab video cameras to monitor drivers and to record accidents is growing more urgent as the rate of fatal truck wrecks continues to rise.”

Industry Resistance Against Cameras

Although quite a few truck carriers have installed in-cab video cameras in their fleets, many of these cameras are what are known as “forward facing.”

Forward facing cameras record footage that a truck driver would see, helping to establish fault in the event that there is an accident involving the truck.

However, truck safety experts believe that driver-facing cameras are necessary to record the behavior of truck drivers before, during and after a wreck.

But as Mike Nalepka points out in an article on the Fleet Owner website, “90% of drivers said they would not sign with a carrier with a driver-facing camera.”

That’s because many carriers believe that 80% of accidents involving commercial trucks are not the fault of the truck driver.

In addition, the article points out that a majority of commercial drivers who were polled for the story believe that rear-facing in-cab cameras are an invasion of privacy.

Success Stories

But this not a universally shared view, as some carriers believe that dual-cameras (ones that face forward and toward the driver) are helping to improve road safety.

Per an article on the Milwaukee Journal Sentinel website, officials at Paper Transport Inc, a truck carrier based in Green Bay, Wisconsin, laud the use of dual cameras.

“Our safety record has been better…” stated Jeff Schefchik, President of the company.

Dan Mills, Safety Director at Millis Transfer Inc., a tractor company with headquarters in Black River Falls, Wisconsin said that dual cameras have provided valuable information related to driver behavior and the behavior of other cars on the road.

NFI Industries – which is based in New Jersey – has lowered its truck accident rates by 50 percent since it installed dual cameras in all its vehicles. The company also cut its insurance rates by as much as 30 percent, according to Craig Bollinger, Senior Vice President of Risk Management.

And the counter to the argument that rear-facing cameras “spy” on truck drivers all day is the fact that there are cameras on the market now that only record footage when some sudden event occurs such as “hard braking, rapid acceleration or swerving from side to side.”

The cameras would not record during a routine driving day, preserving the privacy of drivers who resent the idea that they are being watched all the time.

But during events, which contribute to truck wrecks, truck owners and truck safety directors would be able to watch footage to gauge driver performance in the moments before, during and after a sudden event.

And it’s in these teachable moments that truck cameras can make the biggest difference, according to Del Lisk, Vice President of Safety Services for Lytx, one of the largest manufacturers of cameras for commercial vehicles.

“It’s not just sticking a camera in the vehicle,” Lisk stated in an interview with Trucking News Online. “That isn’t going to do a lot to move the needle in terms of safety.”

Lisk believes that the event recording his company provides is best used to train commercial drivers after they are involved in an incident in which their behavior contributed to an accident, or to some type of occurrence on the road.

Bill Graves, the President and CEO of the American Trucking Associations, one of the largest member trucking organizations in the country, agrees with this assessment.

“Driver monitoring systems hold great promise for mitigating the remaining preventable crashes,” which are accidents Graves refers to as being caused by commercial truck drivers.

For the time being, truck cameras are strictly a volunteer safety measure, but as the FMCSA showed when it instituted mandatory use of electronic logging for hours-of-use reports, regulations can change based on the increasing rate of truck wrecks.

Addiction Treatment Experts Say Have Realistic Expectations About Your Recovery

Recovery is not an event, it’s a process. And like any other process, it takes time, patience, and effort, and things are subject to change at any time. Getting clean and sober is a great start to giving a person the chance to have the best life that they can have, but it isn’t going to happen overnight. Those who are beginning recovery that have unrealistic expectations about what the process of recovery is going to take will become disappointed, and perhaps even angry when things don’t go as they thought they would. The risk then becomes that the disillusionment might lead to relapse.

Why Recovery Expectations Need to Be Realistic

Having realistic expectations in recovery is crucial because:

It better prepares the person for what they are going to go through.

When expectations for recovery are too high, people may judge themselves and their progress too harshly. This can cause anxiety, depression, self-esteem issues, and of course, relapse.

When expectations for recovery are too low, people may not do the things that they need to in order to maintain sobriety.

When someone’s expectation is that recovery will be easy, they may become complacent and not feel accountable for working on their recovery. This can be a disaster in the making.

When things are not going well, or are just not as wonderful as expected, a person can become disappointed and unmotivated – another risk for relapse.

Realistic expectations about recovery will help people to know if they have gotten off track somewhere and when to ask for help.

Understanding the Phases of Recovery

It may be helpful to understand the phases of recovery in order to have more realistic expectations about your recovery. Each person progresses through recovery in their own way, at their own pace, but the following gives a description of the process in general.

The primary phases of recovery are:

The first phase is willingness. This happens when the person reaches a point in their addiction where they become willing to make a change. Some people call it hitting rock bottom. Where exactly that rock bottom is, depends on the individual. Some people end up losing everything before they become willing to change, some become willing much sooner, before negative consequences get too bad.

Next the addicted person begins to investigate options for getting help. There is usually only a small period of time when this happens because it’s so easy for someone with an addiction problem to slip back into denial.

The next phase is when the individual actually takes action to battle their addiction. Maybe they enter rehab, start therapy, or begin going to 12-step meetings. Whatever it is, they are actually doing something and accepting help.

Next is detox from the drug or alcohol. Withdrawal from substances, like alcohol opiates and benzodiazepines, can be very dangerous when done alone. The chemically dependent person should undergo a medically supervised detox for their safety.

Early abstinence is the first months of sobriety. It’s during this phase that the person may feel like they are on a roller coaster of emotions. It’s a difficult time because they can no longer use drugs or alcohol as a coping tool, so they have to actually feel their emotions when they probably haven’t had to for a long time. People in this phase need a lot of support.

The next phase is maintaining abstinence. This phase is where real life happens; there will be ups and downs. These are the years when the person in recovery is putting their life back together, restoring relationships, starting new ones, and learning to live life without drugs or alcohol. There will be challenging times, but also good ones.

After five years or so of sobriety, a person reaches advanced recovery. They will have learned new coping skills and have a firm foundation in recovery, but there is still work to be done.

Some people in recovery get to a phase of serenity. They have put in the work that recovery takes and they are mostly at peace with their life and their recovery. They are able to deal with difficult situations without having thoughts of drinking or using, and they are able to live a fulfilled and happy life.

Tips for Maintaining Realistic Expectations in Recovery

There are numerous things that people in recovery can do to maintain realistic expectations. Some of these include:

Reading recovery material that provides insight on what to expect in recovery. There are many good sources of information out there including recovery blogs online, memoirs and other recovery books, and Alcoholics Anonymous literature and other 12 step program literature for example Narcotics Anonymous.

Talking with other sober people. Hearing other people in recovery share their stories is a great way to understand what ongoing recovery is like.

Joining a 12-step group is also helpful. It will provide individuals with the opportunity to meet and spend time with people in all different phases of recovery.

Writing in a journal can provide people in recovery with a record that documents their progress in recovery. It will allow them to see how far they have come and to set realistic goals moving forward. It is highly recommended to write a gratitude list as well.

Vesper Holdings (“Vesper”), a privately-held real estate investment firm based in New York City, is pleased to announce its sale of Harbor House, a 332-bed student housing property located in Ann Arbor, Michigan.

Vesper acquired Harbor House in 2010 – a year after the property’s developer defaulted on their loan. Vesper applied their signature Campus Life & Style design to refine and enliven the property inside and out. Property improvements included an overhaul of the club house with a sleekly-designed interior that blended contemporary and vintage elements, and introduction of branded amenities including a JOE™ Coffee Bar with a Starbucks® Café Machine. The outdated exercise area was replaced with Vesper’s JIM™ Fitness Center, which features Fitness-on-Demand, yoga rooms and spin rooms. In addition, the pool area received the brand’s signature spa-style upgrades, complete with cabanas and hotel-quality cushioned lounges.

Vesper’s successful execution of the renovation strategy created a financial windfall for its investors. Vesper maintained Harbor House’s occupancy at 100% since 2011 while raising rental rates over 6% annually. Investors received a 40% IRR on a deal level basis over the hold period.

RiskSpan To Open New Headquarters Office In Rosslyn

Currently located in Vienna, Virginia, RiskSpan will move to the 12th Floor of Arlington Tower, located at 1300 17th St North, in Arlington, Virginia.

The new location, a modern office space with 5400 square feet, offers varied collaborative workplaces, video conference rooms, and an open floor plan. It is one block from the Rosslyn Metro and offers wall-to-wall views of the Potomac River and downtown Washington, DC.

The company’s decision to relocate was driven by the need for the abundance of tech talent available in the heart of the DC Metro market. A HousingWire Tech100 winner, RiskSpan focused on identifying a denser corridor of other technology-focused businesses in a transit-oriented development hub.

When asked about the reason for the move, Patrick Doherty, Chief Operating Officer said, “Rosslyn is attracting both large, established enterprises and a new critical mass of tech startups. We are excited to join the neighborhood. Our team is seeking better proximity to other creative technology and business leaders in what has become a real innovation hub in the DC Metro area. Are Escalator Injuries More Common Than You Realize? NYC Personal Injury Lawyer Discusses

Most people ride escalators without giving much thought to safety. Compared to elevators, the “moving stairs” of escalators tend to seem relatively benign.

However, a number of recent escalator accidents has brought new attention to the very real dangers posed by escalators. Recently, an escalator in a busy Hong Kong shopping mall unexpectedly reversed, injuring 18 people. One man suffered a serious head injury and was listed as being in serious condition, according to CNN.

A video of the incident posted online by People magazine shows the packed escalator suddenly slamming into reverse, then speeding up, sending terrified shoppers tumbling into each other. According to one woman who was riding the escalator during the accident, it sped up “two times faster than normal.” The footage, which is dramatic and terrifying, shows just how deadly and dangerous escalators can be.

The People report says that the escalator involved in the Hong Kong accident is maintained by the Otis Elevator Company, the world’s largest manufacturer of elevators, escalators, and moving walkways.

AAJ Says Escalator Injuries and Deaths Are on the Rise

According to the American Association for Justice (AAJ), “for every accident that happens on an elevator, there will be 18 accidents suffered on escalators.”

The AAJ also states that “escalator-related injuries and deaths in the U.S. have been steadily rising every year.” In 1990, there were just under 5,000 escalator injuries and deaths. By 2000, that number had doubled, with over 10,100 people hurt or killed on escalators. In 2013, there were 12,260 reported escalator injuries and deaths in the United States.

Tragically, children and the elderly are far more likely to be hurt or killed in an escalator-related accident. The AAJ reports that children under age 14 and adults over age 65 made up 60 percent of all escalator injuries between 1990 and 1994.
