Transformance Teams Up With FedEx To Donate Food

Initiative Benefits Parents and Students of Uplift Williams Preparatory School

Transformance, a fully integrated social services delivery nonprofit, recently joined with local FedEx team members to distribute food to the families of Dallas’ Uplift Williams Preparatory school.

The donation event, which took place on Wednesday, Oct. 19, was organized by Transformance and Services of Hope, a nonprofit dedicated to helping children and promoting education in our communities. The FedEx team members were invited to participate and did a remarkable job of assembling multiple food staples for all ages into over 700 individual bags.

“We were so pleased to team up with FedEx employees on this initiative,” said Ken Goodgames, CEO of Transformance. “The energy level of their folks really helped set the tone for a successful day of giving back to those in our community. My hat is off to FedEx, Services of Hope and Operation Blessing International for coming together to make this a reality.”

The food donation was carefully scripted to be delivered at the close of the school day, as dozens of families cued up in parking lines to pick up their children. All told, the amount of food donated was over four tons.

Do Older Truck Drivers Put Us All At Risk Asks Truck Accident Lawyer Rand Spear?

Those older than 65 years old are about 10% of all commercial vehicle operators in the U.S. CBS News reports that as the economy declined more workers of retirement age worked longer, some well beyond the age of 65. Unfortunately older truck drivers are not immune to accidents.

A semi driven by a 76-year-old rolled on top of three cars stuck in a traffic jam in Oklahoma, killing 10 in 2009.

In August in Newark, New Jersey, two New Jersey Transit buses collided. The driver at fault was a 70 year old. Two people were killed.

Just days later a truck driven by a 74 year old slammed into traffic in a construction zone in Binghamton, New York. Ten were injured.

According to the federal Centers for Disease Control and Prevention age related declines in vision and cognitive functioning (such as the abilities to reason and remember) and physical changes can affect some older adults’ driving abilities.

CBS News analyzed crash data and found that:

There was a 19% increase in accidents with commercial truck and bus drivers in their 70’s, 80’s and 90’s in the last three years.

There were more than 6,636 accidents involving older truck drivers in 12 states from 2013-2015.

The National Highway Transportation Safety Administration in the 1990’s considered creating skills tests for older commercial drivers because they understood reaction time and stamina can lessen with age. The proposal was never enacted, reports truck accident attorney Spear.

It caused a political backlash against the federal and state governments looking at the tests.

The federal Age Discrimination in Employment Act bans employment discrimination based on age above 40 years old, and trucking companies were struggling to fill open jobs.

Truck driving schools actively recruit seniors promising an income, good benefits and the ability to travel. CBS hired a 70 year old former Texas state trooper and sent him with a hidden camera to a Pennsylvania truck driving school recruiting retirees. A recruiter told him there was no age limit. All the students need to show is that they are physically able to get behind the wheel and drive. The recruiter stated two former students were probably in their 80’s.

When contacted afterward the school defended itself by stating regulations covering the trucking industry have no age limit for drivers (but they must pass a physical) and it would be illegal for them to discriminate based on age.

No one should be discriminated against because of his or her age, says truck injury lawyer Spear, but if a commercial truck driver is not capable of safely driving a truck he or she should be off the road. Given the toll time takes on us all trucking companies and government regulators should take steps to make sure older drivers aren’t a threat to the rest of us on the road.

FAA Wants to Enhance Pilot Professional Development

The Proposed Rule

The FAA says that its proposed rulemaking is a response to the 2009 Colgan Air Flight 3407 crash, which claimed 50 lives. The new FAA proposal follows the Airline Safety and Federal Aviation Administration Extension Act of 2010, which was passed to address safety concerns in the industry, with particular emphasis on regional carriers.

If adopted, the proposed rule would give new pilots a chance to watch flight operation procedures prior to flying with a crew. The new rule would also require all air carriers to change their training for pilots who wish to be promoted to pilot-in-command. There would also be changes for air carriers, who would be required to offer leadership and mentoring training for pilots-in-command. The rule would also create Pilot Professional Development Committees that would be tasked with developing and overseeing pilot mentoring programs.

The Flight 3407 Crash

According to one report, the proposed rule is also due in part to efforts of family members of the victims of Flight 3407. The flight was en route to Buffalo when it crashed into a private home in Clarence Center, New York, killing all 49 people on board and one person on the ground. Investigations by accident experts have revealed that flight errors occurred even before the plane left the ground, including the pilot and co-pilot entering conflicting weather reports into an on-board computer prior to takeoff. The pilot also repeatedly pulled back on the control column instead of pushing it when the plane began to stall. Investigators also say the co-pilot should have corrected the pilot’s mistakes but may have failed to do so due to fatigue.

Transplant Recipient To Co-Chair Taylor’s Gift Outlive Yourself Awards

Shaley and her twin sister Saryn started their sophomore year of high school as new students in San Antonio, where they met Javier Espinosa. The trio spent a lot of time together and soon Javier and Shaley were dating. After high school graduation, they went to colleges in different states. Due to the distance, Javier and Shaley broke up after freshman year. Though no longer dating, they kept in touch because their younger siblings remained friends.

In February of their senior year, Shaley called Javier to wish him a happy birthday and learned he had been sick with mono. Only days after his 22nd birthday, he was admitted to the ICU for acute liver failure. A young and healthy college student, Javier was suddenly given hours to live. He quickly rose to the top of the transplant list.

During his time in the ICU, several family members and friends came to support Javier, including Shaley and Saryn. Semi-unconscious, he only remembered visits from Shaley.

Within three days, Javier received the gift of a perfect liver from an unknown individual who made the decision to outlive themselves. He was out of the hospital two weeks later and made a speedy and full recovery. Javier returned to school after spring break to finish his last semester as an advertising and film major at Southern Methodist University, graduating with honors.

Javier’s liver transplant and full recovery reunited the young couple and made the high school sweethearts realize that they were meant to spend the rest of their lives together. This gift gave Javier a second chance at life – a life he has chosen to continually celebrate to share how immensely appreciative he is for the gift he received. After graduation, he went on to start a company, garner medals in cycling at the U.S. and World Transplant Games, marry his high school sweetheart and start a family of his own.

Javier and Shaley were invited to the inaugural Outlive Yourself Awards in 2015 and have been involved with Taylor’s Gift ever since. Javier, Shaley, Saryn and her husband Jonathan are involved with Taylor’s Gift as a way to say thank you and support organ donor families while raising organ donation awareness so that others can have a second chance at life.

“Taylor’s Gift is the only organization I know of that focuses solely on the donor families. It is truly amazing that the families of those who have recently made the decision to outlive themselves are able to see the bright side of extending life through organ donation,” says Javier, co-chair of the 2016 Outlive Yourself Awards.

The Car Wreck Lawyers of 1-800-Car-Wreck Report On Tesla Auto Accident That Could Trigger Insurer Lawsuit Against the Car Maker

The Texas car wreck accident lawyers at 1800 Car Wreck are reporting on a very recent auto accident involving a Tesla Autopilot vehicle.

The accident occurred in Kaufman, Texas on Highway 175.

According to the driver, Mark Molthan, the Tesla he was driving was unable to take a turn on the highway, and instead, smashed into a cable guardrail several times before coming to a stop.

Although Molthan admitted that he was not fully focused on the road – due most likely to the Tesla’s Autopilot feature – he was shocked that his vehicle’s self-driving capabilities did not take over and properly navigate the turn.

Molthan said that in the moments prior to the auto accident, he had taken a cloth out of the glove box and was polishing the dashboard, confident that the Tesla could navigate the preset route.

“I used Autopilot all the time on that stretch of the highway,” Molthan stated. “But now I feel like this is extremely dangerous. It gives you a false sense of security. I’m not ready to be a test pilot. It missed the curve and drove straight into the guardrail. The car didn’t stop, it actually continued to accelerate after the first impact into the guardrail.”

The auto accident was so severe that Molthan’s insurance company declared the vehicle a total loss.

Molthan was lucky to walk away without being seriously hurt, but said that he had no plans to file a lawsuit against Tesla for the accident.

However, that may not be the case with his insurance company, Chubb Ltd.

Precursor To Insurer Lawsuit?

As more Tesla accidents occur, it is only a matter of time before an insurance company files suit against the carmaker for negligence.

Lawyers representing Molthan’s car insurer sent a notice letter to Tesla Motors Inc. after the accident, asking that the automaker perform a joint inspection of the total loss vehicle.

At issue is whether the Autopilot feature’s malfunction was the major contributing factor to the auto accident, or whether Molthan’s admitted inattention was the main cause of the crash.

It’s a legal gray area, because Tesla has repeatedly stressed to customers that Autopilot is an “assist feature,” that isn’t intended to fully pilot a vehicle.

Prospective buyers interested in a Tesla Autopilot vehicle are provided with a manual that explains the importance of keeping their hands on the wheel at all times in preparation to take over driving responsibilities in the event that Autopilot fails.

Tesla officials have maintained that the fact that Autopilot is semi autonomous conveys to drivers that they cannot rely on the feature to safely operate their vehicles without human vigilance.

But the fact that there has already been one fatality involving a Tesla Autopilot vehicle has raised the stakes in terms of legal action.

Recent Tesla Autopilot Fatal Accident

In May, the owner of a Tesla Autopilot was killed in a devastating auto accident that highlighted the potential dangers of semi autonomous vehicles.

At about 3:40 p.m., Joshua Brown, 45, a resident of Ohio, was driving a 2015 Tesla Model S with Autopilot on U.S. 27 in Williston, Florida.

Unfortunately, the Tesla’s sensor system was not able to detect the presence of a tractor-trailer that was making a left turn across the highway, directly in the Tesla’s path.

As a result, Brown attempted to speed his way out of danger, but the Tesla crashed into the undercarriage of the large truck, shearing off the vehicle’s top half.

After the Tesla ran all the way under the tractor-trailer, it smashed into two fences and a utility pole before coming to a stop.

Brown died at the scene, but the driver of the truck, 62-year-old Frank Baressi was not injured.

Brown was an enthusiastic supporter of Tesla, and had posted videos on social media of his vehicle on Autopilot, marveling at the technology.

Tesla quickly responded to the tragic death by informing consumers that this was the first known death in one of the company’s Autopilot vehicles, and that Tesla drivers had driven more than 130 million miles without an incident.

The statement also said that the driver’s assistance feature is not meant to replace a driver’s hands on the wheel.

“Autopilot is getting better all the time, but it is not perfect and still requires the driver to remain alert,” said part of the statement.

Tesla officials believe that the Autopilot failed to engage the brakes in the Brown accident, because the sensors could not distinguish between the tractor-trailer, which was white, and the brightly lit sky.

Although Brown’s family retained a personal injury lawyer, they have not filed a lawsuit against Tesla regarding the auto accident.

In a statement, the family said:

“In honor of Josh’s life and passion for technological advancement, the Brown family is committed to cooperating in these efforts, and hopes that information learned from this tragedy will trigger further innovation which enhances the safety of everyone on the roadways.”

NTSB Investigation Into Tesla Autopilot Death

Brown’s death triggered a full-scale investigation by the National Transportation Safety Board (NTSB).

In July, the agency released its preliminary findings and said that Brown was speeding in the moments prior to the fatal accident.

In fact, the NTSB said that the Tesla Model S was traveling at 74 miles per hour in a 65-mph zone when it smashed into the tractor-trailer.

The report also said that Brown had activated the vehicle’s Traffic-Aware Cruise Control and Autosteer (a lane integrity assistance feature).

The NTSB said it had not yet determined the probable cause of the accident, and that speed was likely only a contributing factor in the accident.

“All aspects of the accident remain under investigation,” stated NTSB spokesman Christopher O’Neil.

A final report is not expected until July 2017.

Tesla’s Autopilot feature is also under investigation by the U.S. National Highway Transportation Safety Administration (NHTSA) as to whether the semi-autonomous system poses a safety risk to drivers.

False Sense of Security

Part of the issue with vehicles that have semi autonomous features is that they can convince drivers to pay less attention to the road.

“The risk is that these features are intended to be a secondary set of “eyes” on the road,” stated Amy Witherite, partner at the Texas personal injury law firm, Eberstein & Witherite, which also has an office in Atlanta. “But psychologically, drivers are aware that these automatic safety features are supposed to take over the vehicle’s controls if something goes wrong. So there’s a false sense of security that creates more risk-taking behavior, such as taking their hands off the wheel. It’s a real issue as to where the responsibility lies in these types of accidents, especially if the semi-autonomous system fails.”

And part of that false sense of security may be due to the name that Tesla has chosen to give the driver assistance feature: Autopilot.

Recently, Consumer Reports asked Tesla to change the name of the technology, because it was misleading, and caused drivers to mistakenly believe that the vehicle was fully autonomous.

“What Consumer Reports asked Tesla to do was to modify the name of the technology, but more importantly, to disable the feature until the company develops driver assistance technology that will only engage when a driver’s hands are on the wheel,” Witherite added. “That seems to be a reasonable request, given the risks right now to Tesla Autopilot drivers and to other motorists. And we’re about to see more of these types of vehicles on the road, which is quite scary if the technology isn’t foolproof.”

New Guidelines On Semi-Autonomous Features

The debate over semi-autonomous vehicles will only get more intense, because the federal government is soon expected to issue new guidelines related to self-driving vehicles.

And car manufacturers such as Ford Motor Co. are going all-in, preparing to release fully autonomous vehicles in the next year.

Ford officials believe that semi-autonomous vehicles leave too much of a gray area that can cause liability issues, which is why the car maker is designing its self-driving vehicles to perform all operating functions, taking the responsibility off of the person behind the wheel.

Whether that will lower the number of auto accidents involving these vehicles remains to be seen, but one thing that’s certain is that self-driving cars are the wave of the future.
