Joseph Fantini, founder of the Zantac Cancer Compensation Program (ZCCP) and managing attorney at Philadelphia-based Rosen Injury Lawyers, recently spoke out about the problem and made the comments during an episode of 5 Minute Legal Insights podcast.

ZCCP estimate there are over 75,000 individuals in legal claims, and Fantini fully expects the final figure to more than double.

When asked to comment Fantini said, “The U.S. Food and Drug Administration (FDA) took the unusual step in April 2020 in recalling ranitidine, the generic version of Zantac, over concerns of a potentially high dosage content of N-Nitrosodimethylamine (NDMA), a known carcinogen, in the drug.”

Tests revealed Zantac could have 3,000 times more NDMA content than the FDA’s recommended daily dose. NDMA can cause several cancers affecting the prostate, bladder, breast, colon, oesophagal, gastric, kidney, liver, pancreatic, and stomach.

Fantini addressed several frequently asked questions about Zantac, Zantac Cancer Compensation Program’s role, and likely outcomes during the podcast.

He said: “We are presently reviewing ten different types of cancers after our clients took Zantac. Whether they took Zantac eight years ago or one year ago, studies show correlations between the end date of taking Zantac and a person later developing cancer.

“If someone took Zantac for more than a year and was later diagnosed with one of those cancers, we would be interested in talking to them.”

ZCCP brings together the best of the legal and medical world under one roof in helping build legal cases concerning Zantac. “For a client, we get two medical records, one from their primary care physician demonstrating proof of use of Zantac, and the other an oncologist or physician who was treating them,” he explained.

Their experts evaluate the reports before deciding on how to move forward. “We treat each individual on a case by case basis. Each one is different and involves many factors such as how long they took Zantac, their age, their diagnosed cancer and the treatment they had.“

We are not going to string them along or create a false narrative. We want to help as many people as possible, and it’s our ethical obligation to tell the truth.”

Fantini said a typical legal medical case can take between three to five years before concluding. “Experience in this type of case shows 98% of claims are usually settled before they go to trial. However, we appreciate there will always be one case that may go to court and ZCCP is ready to stand up and fight. We have the resources to get the compensation a client deserves.”

When asked to comment, Garner said, “Mistruths of what happens to assets when someone enters a nursing home are all too common. These myths often result in hard-earned assets that are poorly protected or unprotected altogether.”

A widespread misconception is that an individual in a nursing home can give away $15,000 per person a year without receiving a penalty.

“This is confusing for many as this $15,000 is the limit for the federal gift tax exemption allowance and does not have anything to do with applying for Medicaid. Medicaid gifting rules differ: you will be penalized and not qualify for Medicaid benefits for some time if any gifts you make are considered divestments.”

Many elderly people mistakenly assume that purchasing a “Medicaid-friendly” annuity will act as a robust asset protection plan.

“Getting a Medicaid pre-planning annuity isn’t what it used to be. Changes in Medicaid laws at both the federal and state levels have meant that annuities are no longer as helpful in planning for and qualifying for Medicaid; in fact, they can be detrimental, especially if you get one that Medicaid doesn’t consider a “medicaid qualified” annuity,” he said.

Garner added, “The downside to many annuities on the market is that they are regular deferred annuities which are not
“Medicaid-friendly.” Many of the annuities have limited options when it comes to qualifying for Medicaid and can actually narrow the scope of protected assets if you are in a nursing home.”

Another prevalent myth is that the state will seize assets when someone goes into a nursing home.

“You don’t have to hand over anything to the state. In other words, Medicaid won’t dispense any money until you ‘spend down’ your countable or available assets. If you’re not married or if your spouse is already in a nursing home, the amount to spend down is anything over and above $2,000 in cash.”

Garner was quick to add that there are more rules on qualifying for Medicaid, so it’s best to speak with someone well-versed in elder law.

People who didn’t have an asset protection plan before going into a nursing home often think it’s too late to get one.

When asked to elaborate, he said, “It’s never too late to protect your assets. You can still qualify to receive Medicaid benefits even if you have been using private funds to pay for nursing home expenses for years. That being said, the sooner you start proactively planning for your life care planning needs, the better situated you will be when the time comes for the need of long term care.”

“But before acting, make sure to get in touch with an experienced elder law attorney. There are many rules and regulations surrounding what you can and cannot do with your assets that can severely hurt your chances of qualifying for Medicaid,” he commented.

When asked to comment, Shovelin said, “In recent years, more and more people – who are not experts in estate planning – have turned to online services to draw up their living trusts. Unless you are single and don’t own any property, DIY trusts are not the way to go.”

The emergence of online services for living trusts has created a false sense of security for many.

“People who make DIY living trusts go online, download the documents, try to fill them out as best as they can, and then get these documents notarized – all without consulting with an experienced estate planning attorney. They then incorrectly assume that they have all their bases covered legally,” she added.

“However, more often than not, these types of documents are not foolproof enough to hold up in the court of law. This is particularly true if a third party wants to contest the terms of the trust. In other words, some things must be taken into consideration that you might not think of when drafting a living trust to minimize problems in the future.”

Estate planning, according to Shovelin, is a field of practice represented by the legal community for a reason.

“It’s useful to think about it like this: let’s say that you need to undergo a root canal procedure. Would you refuse to seek the help of a dentist and perform the surgery on your own? I’m guessing not. It’s best to have the same mindset when it comes to approaching a living trust and other estate planning documents,” she said.

In this way, living trusts downloaded online fail to address critical legal considerations and obligations, which could pose challenges down the line.

When asked to elaborate, she said, “Drawing up a living trust yourself – instead of consulting with a professional – risks putting your family members through months, if not years, of complications. Some potential obstacles include accidentally disinheriting someone, a delay in asset distribution, and going to probate court. Also, remember these documents are the same documents everyone gets, whether they have no children or 10 and whether they have $100.00 or Millions.”

When asked about the other benefits of working with a seasoned attorney, Shovelin said, “Rarely are two estate planning cases the same. An estate planning professional considers your family’s specific needs and dispenses the accurate legal information so you can be confident that you’ll have a legally viable plan. And it should be a PLAN with contingencies built-in, not just a bunch of one-size-fits-all documents.”

When asked to comment, Hershman said, “Consenting to a police search can be detrimental to your case before you even step foot inside a courtroom. This is true even if you are innocent and have nothing to hide.”

What much of the American public is unaware of, according to Hershman, is that saying “no” to a police search is a fundamental right.

“The 4th amendment of the US Constitution protects citizens against unreasonable searches and seizures. Law enforcement must first obtain permission to search either you or your property – unless they have probable cause that a crime has been committed,” he said.

In fact, he said, refusing a police search often works in someone’s favor in court.

“Let’s say that the police wanted to search you, but they didn’t have probable cause. You didn’t provide consent, but law enforcement searched you anyway. This will give your lawyer the upper hand in court because the officers in charge will have to prove there was probable cause to carry out a search without a warrant,” he added.

Saying “no” to a police search can also, at times, prevent a search altogether.

When asked to explain, Hershman said, “Many people assume that if an officer asks for a search, they will do it no matter what you say. However, if you don’t allow the police to search, and they have no other reason to conduct the search, the encounter should end. Continuing to search you, without your consent or probable cause, will likely not hold up in Court.”

On the other hand, the police will be allowed to produce evidence that could wreak havoc in cases where the client consented to the search.

“Even if you’re positive that you have nothing to hide in your car or home, there’s a chance that an illegal substance could have entered your property without your knowledge. For instance, a friend that you gave a lift could have been carrying a baggie that fell out in the backseat of your car.”

“But even if the police do find something on your property and you didn’t consent to a search, then your lawyer could still challenge whatever evidence law enforcement claims to have against you,” Hershman added.

The Frisco, TX, lawyer urged people to carefully consider the right Power of Attorney, especially if you need it to carry out any living trust matters or decisions that come into play if they become incapacitated.

“The exact powers that are given to the agent of the power of attorney are dictated within that document, so those powers have to be clearly defined,” commented Haiman. “Cheap, generic powers of attorney could well turn out to be the most costly decision, especially when it comes to asset protection, or those surrounding legal and medical issues.”

Haiman elaborated: “When we talk about Medicaid asset protection, if the POA does not define a power to protect an asset transaction, then that has effectively cost you the value of that asset.”

General powers of attorney will be no good to an agent who needs more detailed or critical provisions to make seamless decision-making.

Haiman advised those who are handed responsibility for a POA, for example, for a spouse or parent, they should have an estate planning lawyer review it to determine whether it’s suitable and detailed. A POA is only as good as the financial institutions that it’s presented to, so if they feel it’s not detailed or specific enough, they will not accept it. This would be just like not having one at all.

This could well come into play on issues surrounding Medicaid, such as adopting a Miller Trust for a parent or spouse whose income exceeds the statutory limit.

“Waiting until after someone becomes incapacitated and unable to sign documents to affect their long-term care will be too little too late if that cheap power of attorney doesn’t give you exactly what you require,” he concluded.

“A cheap, inappropriately written power of attorney could well come back to bite you financially and at the worst possible time.”

He suggested an executor’s inability to communicate with beneficiaries and creditors correctly and in a timely manner were among the most significant failings. Known creditors must receive notice of a pending estate administration, and the estate has to remain open for a statutory period to enable creditors time to file a claim in the estate.

“Equally, failing to keep beneficiaries abreast of developments can lead to unnecessary litigation.” In both cases, Huguelet advised executors to seek professional advice and retain the services of a probate attorney who can act as a guiding hand.

“Not hiring an probate attorney means the process might take longer than necessary, and an executor may make costly errors during the probate process.”

Failure to handle creditors’ claims, looking to distribute assets too quickly, calculating estate taxes correctly and neglecting to issue an inventory and/or an accounting in an estate are some of the errors made by executors Huguelet has also come across.

“Executors can also fail to look at alternatives to the formal probate administration. In Illinois, a small estate affidavit may be an option instead of formal probate, saving considerable cost and time in the process.”

Superfast IT has signed the Armed Forces Covenant in a virtual signing event attended by Wing Commander Simon Briggs, Royal Air Force.
