She said that someone else would take responsibility for a person’s finances and decision-making in the event of incapacity. “But those decisions, if not already laid out in their estate planning, may well not align with the person’s wishes. So estate planning now takes out the worry and concern if for any reason you become incapacitated.”

Ungvarsky advised you to take action now and designate a power of attorney for your estate. “A person, or agent, with power of attorney, will be your legal, financial, and healthcare decision-maker and follow your stated wishes to the letter in case you become incapacitated.”

She advised utilizing a person they could trust implicitly or nominating a licensed bonded professional. “It’s critical that when setting up powers of attorney, you communicate with your agent your wishes and goals both financially and medically.”

Never assign joint ownership of your assets and finances. “Joint ownership adds another owner to your accounts or assets. If that joint owner runs into some trouble, your account or property can be used to pay their debts even if they never contributed to the asset.”

Ungvarsky said anyone considering joint ownership to take legal advice first to understand and be comfortable with the implications involved.

Establishing a living trust is another effective step. “This involves retitling certain assets under the ownership of a trust and overseen by a successor trustee who will make decisions on those trust assets if you are incapacitated,” she detailed.

“That trustee will wield much power in managing trust assets, so you need to think carefully in appointing a person you trust completely and one who will carry out your wishes.”

Ungvarsky advised anyone considering estate planning to seek advice from an experienced estate planning attorney. They will offer the best options to ensure a plan is robust enough and reflect a person’s wishes if they become incapacitated.

“If you earn over $12,000 annually, you need to pay taxes on that income,” she advised. “And if you earn over $600 from a client, and they don’t file you a 1099-MISC form by January 31, you are still eligible for any taxes owed.”

She advised that anyone dealing with international clients would also have to address tax issues. If you’re a US citizen, tax payments are owed to the US government regardless of where your clients are located.

But if you live in another country, you could well be liable for taxes in that country. To avoid double taxation, US citizens can reduce that burden by considering specific provisions such as foreign tax credit and deduction, and foreign-earned income exclusion.

Ho said there were many examples where a business could deduct an expense that is considered ordinary and necessary. “Turning to a specialised accountant will help business owners be sure of what they can deduct as part of their ongoing expenses during the year.”

Another is for the home-office based activities that many are now engaging in for business reasons. “You can deduct a home office expense for an actual workspace which is 100% dedicated to the business.”

One key area she agreed on that was essential for tax filings was keeping all business receipts. “This is particularly handy if your business gets audited as you will have to provide proof of payment and that it was suitable for your business needs.”

She revealed that asking for an extension beyond April 15 doesn’t apply to tax payments owned, only to filing the tax returns. Sole proprietors are eligible for self-employment tax, while for incorporated businesses, owners are responsible for paying self-employment tax on the salary they receive from the business’s earnings.

She added: “A good idea is to deploy a bookkeeping software system for your business as that will help your tax management over the year. And having an accountant in your corner for advice and filing tax returns is an excellent option as taxes become more complex and involved.”

“Maintaining Chapter 13 repayments and keeping up with the mortgage, means your house will be secure,” he said.

Another point is that people fear they can’t sell their homes if they opt for bankruptcy. But that’s not the case, he added. “You can sell your house, keep the exempted proceeds for yourself and any monies left over will be used to help clear your debts.”

He added that legal fees may well be higher if someone opts for Chapter 13 filing, but you may opt to have your attorney have all or a portion of the legal fees paid through your plan.

Keenan advised anyone thinking of bankruptcy should first consult a professional, experienced attorney to talk them through the process and to ensure that they fully understand the potential ramifications of filing for Chapter 13.

She added: “Find out what they charge for the work of their administrative staff, what they require as a retainer, and how often you will be expected to replenish that retainer. Always be clear of what financial outlay you will need.”

An attorney is only as good as the information that is in front of them, she said, adding: “Clients need to communicate honestly and effectively with their attorney and never resort to lies. If an attorney learns the truth in the middle of a trial, they will not be properly prepared and it will not go well for the client. Keep in mind that everything the client tells the attorney is confidential and protected, so don’t be afraid to admit to less-than-flattering behavior.

“They should also try to be efficient in their communications – so one email with 15 questions, rather than 15 separate emails, will save the client substantially. Also consider a strategy of timely meetings that review the process and the lawyer’s work for a smoother, quicker process.”

Another costly error to avoid is not keeping up to date with paperwork and bumping right up against deadlines, as mistakes will double the work and potentially double the bill for avoidable mistakes.

“If you have to go to trial, then file first for divorce. There is a huge psychological advantage to being able to tell your story to the court first, rather than being on the defensive.” Weinman added.

“But above all, keep a cool head and try not to let emotions, such as resentment, get the better of you during the divorce process. Dragging your feet or avoiding issues that need to be tackled will only see you bear the burden of spiraling costs.”
