Why Commercial Trucks Crash By Philadelphia Truck Accident Lawyer Rand Spear

Commercial vehicle accidents result in a tremendous cost to victims, society as a whole as well as to trucking and insurance companies. Because of the substantial costs studies of these accidents and their causes are being done to discover ways to prevent them in the future and avoid deaths, injuries and financial losses. Philadelphia truck accident lawyer Rand Spear says most commercial truck accidents are due to mistakes by their drivers.

The Federal Motor Carrier Safety Administration and the National Highway Traffic Safety Administration conducted the Large Truck Crash Causation Study (LTCCS) to discover the reasons for serious crashes involving large trucks. They looked at about 120,000 large truck accidents involving 141,000 trucks which occurred between April 2001 and December 2003.

Crashes involving at least one large truck which resulted in a fatality or injury included:

963 crashes involving 1,123 large trucks and 959 other motor vehicles.

They resulted in 249 fatalities and 1,654 injuries.

73% of them involved a large truck hitting at least one other vehicle.

Half of the LTCCS crashes were collisions of a large truck and a passenger vehicle. Researchers found a statistically significant connection between these ten factors (listed in descending order) and the critical event (the action or event that made the collision unavoidable):

Traffic flow interruptions

Driver unfamiliarity with the roadway

Inadequate surveillance

Driving too fast for conditions

Illegal driving maneuver

Inattention

Fatigue

Illness

False assumptions of what other drivers would do, and distractions by objects or another person inside the vehicle.

When looking at all large truck accidents the LTCCS found that there were three kinds of critical events:

Driving out of the travel lane, either into another lane or off the road.

(32% of the accidents) loss of control because the truck was traveling too fast for conditions, cargo shifted, a vehicle system failure, poor road conditions or some other reason (29%).

Rear ending another vehicle (22%).

The study also looked at critical reasons (the immediate reason/failure leading to the critical event) for heavy truck accidents. Researchers were able to come up with critical reasons in 55% of the accidents in the study. The most common were:

The terms the FTCCS uses mean:

Decision: The driver chooses to drive too fast for conditions, misjudges the speed of other vehicles or follows too closely.

Recognition: The driver was inattentive, distracted or failed to observe the situation adequately for some reason.

Non-Performance: The driver was asleep, disabled by a heart attack or seizure or physically impaired for some reason.

Performance: The driver panicked, overcompensated or didn’t control the truck correctly.

When a commercial truck accident results in injuries or deaths of those in other vehicles, pedestrians, motorcyclists or bicyclists, if a truck driver’s mistakes cause the accident, or there is some kind of equipment failure or shift in cargo leading to the truck going out of control, those harmed in the accident may have legal claims for compensation against any number of possible defendants.

Amy Witherite Discusses Walmart’s Decision To Test Dual-Facing Cameras In Semis

By now, you have probably heard of the fatal semi-truck wreck involving a Walmart truck driver, Kevin Roper, 35, of Jonesboro, GA, and comedian Tracy Morgan. Morgan suffered a traumatic brain injury, but his friend, James McNair, was killed in the accident. Investigators discovered that the truck driver who caused the accident had been awake for 28 hours straight at the time of the wreck and was charged with manslaughter.

The truck wreck brought new awareness to the issue of “trucker fatigue” and the abuse of hours of service regulations, which currently limit truck drivers to 11 consecutive hours behind the wheel. The National Transportation Safety Board (NTSB) has placed some of the blame for the accident on Walmart, saying the company should have done a better job of training and educating their drivers.

NTSB Chairman Christopher Hart believes regulations can only go so far and that companies that employ truck drivers must be vigilant about creating a work culture that discourages violations of safety rules to prevent truck wrecks.

Inward-Facing Cameras Divide Truckers

Perhaps in response, Walmart recently announced that it is testing dual-facing cameras in some of their semi-trucks. The retail giant has a fleet of about 6,000 trucks. Currently, the program is volunteer-only, with the dual-facing cameras only placed in trucks of drivers who agree to have them on board.

Amy Witherite, co-founder and principal of Eberstein Witherite says, “There are other trucking companies exploring the idea of having these types of cameras in their trucks. Some companies have combined the cameras with other technologies, such as warning systems that signal a trucker when the truck drifts out of a lane. There are even safety systems that brake automatically if a truck gets too close to another vehicle.”

The dual cameras record both the view immediately ahead of a semi, as well as the interior of the truck, including the driver. The goal is to cut down on safety violations, including texting and driving, talking on cell phones, and driver inattention — all activities that can cause a devastating truck accident.

However, not all truck drivers are thrilled with the idea of inward-facing cameras.

One trucker likened the interior of his cab to his office, and the area behind his front seat as his home away from home, where he sleeps when he’s on the road. He compared the camera to a Peeping Tom, claiming that the camera is a serious invasion of privacy.

Other drivers support the dual cameras, saying it protects them in the event of an accident. They claim that having video footage of the road as well as their actions behind the wheel can prove they were not responsible for a collision.

Info Missing From Nursing Home Reports Says Boca Nursing Home Abuse Lawyer

The State of Florida, which investigates complaints of abuse and neglect and issues reports after these investigations, is accused of leaving out so much information on these public reports that they are of little use to those who want to know what’s going on in these facilities. Boca nursing home abuse lawyer Joe Osborne says this trend may make it easier for nursing homes and assisted living facilities to avoid being held accountable for mistreating residents.

The Orlando Sentinel, in an article published last month, stated that if you want to look at public records concerning a nursing home or assisted living facility where you might place a loved one, you may find so much information redacted that the reports have little or no practical use. Dates, places and words describing what happened may be removed from public view.

Brian Lee of Families For Better Care based in Austin, Texas, a watchdog group focused on the welfare of nursing home and assisted living facility residents, called Florida’s heavily censored reports “shocking.” Lee told the newspaper he first noticed more information was being withheld starting late last year. Lee also said someone reading a report may not be able to make any sense of what went on.

The Florida Agency for Health Care Administration (FAHCA), the agency creating the reports, denied that allegation. The Sentinel states the reason they gave for the redaction is to protect personal health information as required by federal privacy laws. The agency’s press secretary stated if the information wasn’t redacted someone may be able to connect it with publically available information to identify protected health information.

The agency provided the Sentinel an internal email from December referring to a “new redaction process” which is being done by an automated process which may have eliminated more information than necessary. The agency official stated they were working on improving the quality of the redactions.

The FAHCA routinely inspects the state’s 683 nursing homes annually and once every two years for Florida’s more than 3,000 assisted living facilities. There are additional investigations when serious complaints are filed. Reports from the investigation are normally posted online on FloridaHealthFinder.gov.

The Sentinel quoted Lee as saying,

“I haven’t seen anything this blatant, as far as the disregard of the public records laws, as what’s coming out of the Agency for Health Care Administration right now,” he said. “And their attitude is very nonchalant, that this is just a computer glitch. It’s crazy — and, most importantly, it’s a disservice to residents and their families.”

These reports can be helpful when we investigate possible neglect and abuse at a nursing home or assisted living facility and the state needs not only to be concerned about privacy, but also the safety of residents. Incident reports that look like Swiss cheese also won’t help families choose safe facilities for their loved ones to try to avoid abuse and neglect before it starts.
