When asked to comment, he told listeners, “The cost of nursing home care nationwide has gotten out of control. It’s very easy for it to cost anywhere from $60,000 – $100,000 a year. And there are different levels of care, and the more care you need, of course, it gets more and more expensive. In the US, 2 out of 3 people who are older than 65 will require some form of long-term nursing home care.”

According to Haiman, there are three ways to pay for long-term care: out-of-pocket, long-term care insurance, and Medicaid.

“For out-of-pocket, you’ll have to tap into whatever resources you have – such as personal savings, pensions, stocks, bonds, and home equity – to pay for it. There’s also long-term care insurance, which not many people have, since the cost of long-term care has risen so dramatically, most people can’t afford it. The last one is to qualify for Medicaid. And Medicaid has become a big asset to look into to help a family pay for these long-term needs,” he said.

Haiman pointed out that several misconceptions about Medicaid cause many people to overlook it as a solution to pay for long-term care.

When asked to elaborate, he said, “Some confuse Medicare and Medicaid and think that Medicare will pay for long-term care, but it doesn’t. Medicare pays for medical expenses and short-term care only.

Furthermore, one of the biggest things that people don’t realize is that Medicaid is not for the poor – it’s for the “qualified.”. Many times, people will hear the term ‘Medicaid’ and think that they don’t want to be on it since they are not poor. But the reality is that Medicaid is for people that can qualify for the program, and the government sets the rules on qualification.”

However, Haiman quickly pointed out that the rules for qualification are so tricky that one often needs to legally manipulate the system in order to qualify for Medicaid. To get around this, the Haiman Hogue law firm offers an Elder Care Protection Plan.

When asked to comment, Keenan replied, “An eviction moratorium doesn’t mean that you can simply move or that your debts will be magically cleared away. Once the eviction moratorium ends at the end of the year, anything you owe – whether its mortgage or rent payments – will be due. Here is what you can do to address your debt.”

It’s important that anyone who has housing debt tackle the problem head on.

“Whatever you do, don’t brush aside your housing debt. Ignoring the problem will make it worse. A collections lawyer will go after you in an attempt to get the money you owe. Furthermore, creditors will stop at nothing – including wage garnishment and seizure of assets – until the debt has been repaid in full,” he said.

“The second reason to begin the bankruptcy process before the eviction moratorium ends is so you can file at the right time. It’s likely that the bankruptcy courts will experience a backlog of cases when everyone begins filing in the new year,” he said.

Keenan was quick to add that making the decision to file for bankruptcy can eliminate worries and concerns about what will happen once the moratorium ends.

“If there’s ever a time for a fresh start, it’s now. COVID-19 has negatively impacted the livelihoods of millions of Americans and left many people in debt. Bankruptcy will wipe your debt slate clean and provide you with peace of mind during these unprecedented times,” he said.

When asked for a comment, she said, “The common misconception is that people think they need a Will to protect their loved ones after they’ve passed. People don’t think about what would happen if they were mentally and physically incapable of handling their own finances while still living. Unfortunately, a Will doesn’t do anything to address this.”

According to Shovelin, there are numerous other legal documents that need to be put in place to help with financial, legal and healthcare management while someone is still alive.

“If you don’t have these safeguards in place, then your resort is in the courts, which is costly, time-consuming, and public – and people don’t want that.”

Shovelin alluded to the fact that a Will does not help people avoid probate, which is the legal process for disseminating the property or assets of a deceased person to heirs.

“Essentially, probate equals time and money. It takes time to go through the courts to have your will probated. There’s a whole probate process that you have to go through, which is overseen by the courts. You have to do the reporting, so it’s onerous, time-consuming, and expensive,” she said.

The probate process takes at least three months in most cases, but can go on for years, during which time monies left behind via a Will cannot be accessed by family members. To make matters worse, the waiting time has been exacerbated due to the backlog of cases during the COVID-19 pandemic.

A Will fails to address what will happen when someone becomes incapacitated, which could be particularly problematic from a financial perspective.

“It could be disastrous, particularly if you’re a single individual or if you’re married and don’t have joint accounts, then your loved ones or your spouse may not have access to your bank accounts or monies to cover expenses or bills. And so again, you would have to go through the courts just to gain this access, which can be very overwhelming to families who are already going through a stressful time,” she said.

“If you don’t have the proper planning in place and you’re not able to speak directly with doctors, then the question becomes who is responsible for making medical decisions on your behalf – and that can be very confusing in a time that’s already difficult on your loved ones as is.”

Shovelin further highlighted that a ‘Living Lockbox’ is a great way to ensure that loved ones are taken care of, no matter the situation.

“A ‘Living Lockbox’ is essentially a way that you can bypass probate altogether and allow your inheritance to more seamlessly transfer to your heirs without that oversight from the courts. Essentially, my clients who are using the ‘Living Lockbox’ are guaranteeing their own personal and financial security, as well as the financial security of their loved ones, without having to deal with the courts.”

It’s important that you establish those legal structures, not anyone else, otherwise your initial wishes may not be met.”

Huguelet quickly added that people often think they can quickly throw together an estate plan using DIY websites that offer readymade templates.

“This is simply not the case. Estate planning is not one of those things you want to go at on your own. Many people often assume that the process is assigning an executor to be in charge of a will and a trustee to manage a trust. However, a robust plan needs to take into account the many possible life events, such as if the beneficiary you assign were to become incapacitated or even to pass away,” he said.
