Lemont Construction Site Accident Initiates Comments From Construction Accident Lawyer

June 12, 2016 – – Thomas Moverman of LipsigLawyers.com echoed his support for a Chicago couple who have filed a lawsuit case against 3 businesses, in which they cite negligence as the cause of the injuries the husband sustained while at work. Moverman noted that construction accident victims are entitled to seek justice for injuries sustained while at work. He also emphasized that with greater safety regulations and precautions fewer injuries would occur in the construction industry.

According to a report from the Cook County Record, the Chicago couple filed lawsuit cases against UChicago Argonne LLC, Clark Construction Group, and Jacobs Engineering Group, Inc. The plaintiff states that the construction site he was working at did not maintain a safe working environment. The victim stated that he was working as a pipefitter, when he slipped in mud, and was struck by a falling pipe.

The Cook County man sustained severe permanent undisclosed injuries, with symptoms such as severe physical pain, mental anguish, along with hefty medical expenses. Those symptoms are extremely common for non-fatal work-related injuries which often result in fractures, severe bruising, and head trauma.

Slips, trips, and falls, are the leading cause of death in the construction industry. According to the Occupational Safety & Health Administration, there were 349 fatalities in the private construction industry in 2014, totaling 40 % of all construction work-related fatalities. The plaintiff, in this case, was also struck by an object, which in 2014 was the third leading cause of fatalities for the construction industry, resulting in 73 deaths in the private construction industry. According to the Bureau of Labor Statistics, In 2014 there were nearly 3,000,000 non-fatal injuries and illnesses along with close to 5000 fatalities due to work-related injuries in private industry.

Lipsig, Shapey, Manus, & Moverman are currently offering all individuals affected by construction accidents a free legal consultation. Thomas Moverman indicates that many of the construction accidents that occur today could easily be prevented and that each victim of a construction accident deserves proper representation and counsel. Death Of Taylor Creek Construction Worker, Spurs Comments From Construction Accident Lawyer

June 12, 2016 – – LipsigLawyers.com’s Thomas Moverman referenced the death of a local North Carolina construction worker to emphasize how important it is for OSHA and federal regulators to issue more extensive safety precautions for the construction industry. Moverman called the death of the North Carolina resident a tragedy and hopes that through revisions to the current safety regulations and precautions that grim accidents similar to this will have no place in the future of the construction industry.

According to WNCT.com, the 42-year-old victim was installing roofing at a new boathouse building when he slipped and fell 40 feet to the ground. The incident happened at The Boathouse at Front Street Village on Lennoxville Road. Other workers witnessed the tragic fall and rushed the victim to Carteret HealthCare where he was treated for life-threatening injuries. Regrettably, the victim passed away shortly after reaching the urgent care center.

The Occupational Safety & Health Administration (OSHA) classifies this incident as a slip, trip, and fall. Slips, trips, and falls, accounted for nearly 40 percent of construction work-related fatalities in private construction during 2014, taking the lives of 349 hardworking individuals. OSHA listed slips, trips, and falls as the number 1 cause of death in the private construction industry in 2014.

The Bureau of Labor Statistics (BLS) determined that the death toll for work-related fatalities increased by 5 percent from 2013 to 2014. Sadly, the number of work-related fatalities from 2014 was the highest number of work-related fatalities for a year since 2007.

The law firm Lipsig, Shapey, Manus, & Moverman are looking to assist all individuals who have been affected by work-related injuries and fatalities. The law firm is offering complimentary consultations so that each individual is provided an equal opportunity to pursue their complete legal rights. Xarelto Lawsuit Plaintiffs Claim Commercial Misleads Public Regarding Drug

June 12, 2016 – – TheProductLawyers.com reports on the allegations of plaintiffs who claim that the advertising campaign undertaken by Janssen Pharmaceuticals, a subsidiary of the Johnson and Johnson Corporation, and Bayer AG, was misleading. They claim that the makers of Xarelto have retained celebrities and famous athletes to endorse the benefits of Xarelto, but failed to sufficiently state the dangerous potential risks involved with taking the drug.

The commercial which they refer to features Saturday Night Live star Kevin Nealon, golf great and legend Arnold Palmer, NBA star Chris Bosh, and NASCAR driver Brian Vickers. Each of these celebrities endorses the benefits of Xarelto and provide information about the drug but fail to mention risks such as excessive bleeding that may cause death.

There have been thousands of lawsuits filed against Janssen and Bayer since the drug was released to the market with over 2,800 being consolidated into a multidistrict litigation (MDL) in Louisiana under the oversight of the Honorable Judge Eldon Fallon. Another 550 cases have been consolidated in a mass tort program in Philadelphia, PA. The plaintiffs in these cases have a much different view of the drug than that expressed by the celebrity spokespersons in the Xarelto commercial. Many plaintiffs are questioning the tactics of the manufacturers and feel the ad is very misleading. They allege that Xarelto puts them and potentially many others at the risk of severe uncontrollable bleeding.

It should also be noted that the U.S. Food and Drug Administration (FDA) has issued two black box warnings for the drug since the agency approved it for release to the market. Black box warnings are quite severe since these warnings can frequently indicate that a product is about to be pulled from the market.

The attorneys of Banville Law, the firm behind TheProductLawyers.com, are offering complimentary consultations to anyone who suffered injury or hospitalization after a bleed while on Xarelto. For more information about this release or the Xarelto litigation call 888-997-3792.

West Village Scaffolding Fatality, Compels Construction Accident Lawyer’s Comments

June 12, 2016 – – Thomas Moverman of LipsigLawyers.com has referenced an April scaffolding incident as evidence that construction safety reforms are imperative. In West Village on April 22nd, a local 32-year-old man sustained fatal injuries while he was attempting to dismantle scaffolding from a West Village luxury condominium. Moverman sends his condolences to the family of the fallen victim and points out that incidents of this nature occur entirely too frequently.

According to a report from the New York Post, the man was on the ground floor dismantling scaffolding when a piece of wood debris fell from the 10th floor and struck him. When first responders arrived on the scene they found the victim unresponsive with severe neck and back injuries. EMS transported the man as quickly as possible to Lenox Hill Hospital. Sadly, the doctors could not stabilize the man, and he was pronounced dead shortly after arrival.

This is not the first time that an individual has been struck by an object while at a construction site. The Bureau of Labor Statistics (BLS) claims that nearly 10 % of fatal occupational injuries are a result of being struck by an object or piece of equipment. In fact being struck by an object is the third leading cause of deaths on construction sites as reported by the Occupational Safety & Health Administration (OSHA). OSHA also indicates that out of the 4,251 worker fatalities that occurred in private industry during the calendar year 2014, construction worker-related deaths accounted for over 20 % of the year’s total.

Lipsig, Shapey, Manus, & Moverman are a New York based law firm, and they are offering all victims of construction accidents access to their legal services. Likewise, they are offering individuals affected by construction accidents a free legal consultation. Thomas Moverman is one of the top attorneys representing victims of construction accidents and has had considerable success in previous cases. One previous case the firm took on resulted in a sizable compensation for their client, totaling $20,000,000 for damages as a result of a trench collapse.

June 12, 2016 – – Thomas Moverman of LipsigLawyers.com mentioned a January construction accident while placing tremendous emphasis on the need for construction safety reforms. In January, a local construction worker fell 4 stories down an elevator shaft. Moverman explained that cases of this nature are not uncommon, furthermore, he sympathizes with the victim and hopes that the victim will have a speedy pain-free recovery.

The New York Times reported that on January 27th, a local Manhattan construction worker was not wearing a harness and fell 4 stories, where he was impaled by metal bars and struck by falling cinder blocks. The report details that the NYPD stated that the man fell at about 8:00 a.m. while he was preparing to hang drywall. Xarelto Lawsuit Plaintiffs Allege Advertising For Drug Is Deceptive

June 12, 2016 – – TheProductLawyers.com reports on plaintiffs suing the makers of Xarelto, Janssen Pharmaceuticals, a subsidiary of the Johnson and Johnson Corporation, and Bayer AG, and their claims regarding the Xarelto commercials with celebrities promoting the benefits of the drug. The commercial in question is a promotional piece featuring popular athletes and television celebrities such as NBA star Chris Bosh, Saturday Night Live personality Kevin Nealon, golf legend Arnold Palmer and NASCAR driver Brian Vickers. Each of these celebrity spokespersons speaks about the benefits of the drug, but fail to mention the dangerous risks that many patients taking the drug face. Plaintiffs in the over 3,000 cases have a much different view of the drug than the one being represented in the commercials.

In a disturbing development, the U.S. Food and Drug Administration (FDA) has given Xarelto two black box warnings since the agency approved the new-generation blood thinning drug. A black box warning is a very severe and harsh warning that a product can get before it is pulled from the market entirely.

Since its release on the market, Xarelto has become the focus of many federal courtroom proceedings across the United States. Over 2,800 cases have been consolidated by the U.S. Judicial Panel on Multidistrict Litigation (JPML) because all the cases involved the same defendants, Janssen and Bayer, and had the same allegations related to excessive bleeding levied in all of the court filings. The multidistrict litigation (MDL 2592) has been placed under the oversight of the Honorable Judge Eldon Fallon in the Eastern District of Louisiana.

While these plaintiffs await their day in court, another 550 have been consolidated in a mass tort program in Philadelphia, PA. It is expected that more cases will be added while these wind their way through the legal system.

The attorneys of Banville Law, the firm behind TheProductLawyers.com, are offering complimentary consultations to anyone who suffered injury or hospitalization after a bleed while on Xarelto. For more information about this release or the Xarelto litigation call 888-997-3792.

Xarelto Lawsuit Plaintiffs Press On With Case, Alleging Celebrity-Filled Ads Are Deceptive

June 12, 2016 – – TheProductLawyers.com reports on the U.S. Food and Drug Administration’s (FDA) issuance of two black box warnings in relation to Xarelto, a new-generation blood thinner drug manufactured by Janssen Pharmaceuticals, a subdivision of the Johnson and Johnson Corporation, and Bayer AG. Black box warnings are the harshest type issued before a product is ordered to be removed from the market completely.

Numerous lawsuits have been filed in federal courtrooms across the United States alleging the drug has caused severe, and sometimes fatal, uncontrollable bleeding in patients. There have been over 2,800 cases consolidated by the U.S. Judicial Panel on Multidistrict Litigation (JPML) which all contain similar allegations about the drug and all of which name the same defendants. The multidistrict litigation (MDL) is being overseen by the Judge Eldon Fallon in Louisiana and is filed under number 2592. More cases are expected to be added to the MDL as time goes on.

An additional 550 lawsuits have been consolidated in Philadelphia, PA in a mass tort program.

The makers of Xarelto have used a public relations campaign to promote the benefits of the drug in TV commercials using various celebrities such as golf great Arnold Palmer, NBA legend Chris Bosh, NASCAR star Brian Vickers, and Saturday Night Live persona Kevin Nealon. These celebrity spokespersons talk about their use of Xarelto and how it has helped them keep various medical conditions in check but they do not address the many concerns and dangerous risks that have come to light since the drug was released on the market.

The plaintiffs in the many cases filed, however, have a very different perspective of the drug than that being expressed in the commercials. The plaintiffs suing the makers of Xarelto allege the drug placed patients at risk of severe internal bleeding, which has been fatal in many cases.

The attorneys of Banville Law, the firm behind TheProductLawyers.com, are offering complimentary consultations to anyone who suffered injury or hospitalization after a bleed while on Xarelto. For more information about this release or the Xarelto litigation call 888-997-3792.

Madison Avenue Scaffolding Incident Prompts Response From Construction Accident Lawyer

June 12, 2016 – – LipsigLawyers.com’s Thomas Moverman comments on the construction accident that occurred in Midtown in February where a construction worker was severely wounded while on the job. Moverman urges the victim to remain positive during this difficult time and hopes that the victim will be able to return to work at some point in the near future.

As reported by ABC 7 New York, the worker was doing demolition work at 317 Madison Avenue, when he was struck by a large piece of concrete leaving him in critical condition. Had the victim not been secured by a rope, he likely would not have survived.

When Emergency Medical Technicians arrived on the scene they attempted to use the elevator to secure the victim, however, the power was out. Responders then utilized a “high angle technical rescue” technique in order to safely transport the victim out of the building. FDNY officials say that while it is unclear whether the debris was a result of the ongoing demolition work, there was another accident at the site in 2015.

Injuries that are typically associated with construction injuries include lacerations, fractures, brain trauma and severe bruising. The Occupational Safety & Health Administration (OSHA) indicated that in 2014 there were about 3,000,000 work-related injuries and illnesses in America, and nearly 5,000 work-related fatalities.

OSHA states that nearly 60 percent of all construction accident fatalities in 2014 occurred from the ‘Fatal Four’ causes. The ‘Fatal Four’ includes falls, electrocutions, being struck by an object, or being caught between or inside equipment or an object. The Bureau of Labor Statistics (BLS) concludes that by eradicating the ‘Final Four’ regulators could save nearly 500 construction workers lives per year.

Lipsig, Shapey, Manus, & Moverman aim to provide all individuals affected by construction accidents with legal advice. Additionally, the firm is offering each victim the ability to seek out their complete legal rights through a free legal consultation. Thomas Moverman is one of the lead attorneys for construction accident victims and has had substantial success in similar cases. In one instance, Moverman fought for his client and helped to obtain a $1,780,000 compensation after the client sustained a severe back and neck injury following a slip and fall.

Xarelto Lawsuit Update: Plaintiffs Claim Marketing Tactics Are Deceptive

June 12, 2016 – – TheProductLawyers.com reports on Xarelto and the many ads promoting the drug using popular athletes and celebrities such as NASCAR great Brian Vickers, golf legend Arnold Palmer, NBA player Chris Bosh and Saturday Night Live’s Kevin Nealon. In this particular commercial, all of the cited celebrity individuals are talking about the benefits of Xarelto but they fail to sufficiently the numerous concerns that many patients have with the drug and the risks associated with using it.

Many plaintiffs in the numerous lawsuits filed since the drug was released to the market have a very different view of the drug than those being expressed in the commercial. A good number of those pursuing legal action against the makers of Xarelto find it disconcerting that they and many others have been put at an increased risk of experiencing potentially life-threatening uncontrollable bleeding that can lead to death in the extreme case.

There have been in excess of over 2,800 lawsuits filed against the makers of the drug, Janssen Pharmaceuticals, a subsidiary of the Johnson and Johnson Corporation, and Bayer AG, with more expected. These suits all similarly allege that the drug puts users at an increased risk for uncontrollable bleeding episodes. These cases come from all across the United States and have been consolidated into a multidistrict litigation (MDL) number 2592. The MDL is being overseen by the Honorable Judge Eldon Fallon in the Eastern District of Louisiana.

It should be noted, that since its initial approval of the drug, the U.S. Food and Drug Administration (FDA) has given the new-generation blood thinner two black box warnings. The black box warnings are the harshest warnings that the FDA can give a product before it is ordered off the market completely.

The attorneys of Banville Law, the firm behind TheProductLawyers.com, are offering complimentary consultations to anyone who suffered injury or hospitalization after a bleed while on Xarelto. For more information about this release or the Xarelto litigation call 888-997-3792.

June 12, 2016 – – Thomas Moverman of LipsigLawyers.com praises a local New York doctor following the events that occurred in Brooklyn on April 22nd. The local construction worker was struck by a falling light pole which knocked the man into a 15-foot trench. Attorney Moverman emphasized that the victim likely would have lost his life, without the caring assistance from the local doctor.

NBC New York’s news report indicates that a construction worker was working on a site on East 49th Street near Kingsbrook Medical Center at about 8:30 A.M. in East Flatbush.
