Are Weaponized Police Drones On Their Way?

It may sound like something out of a science fiction movie, but weaponized drones may soon be hitting the skies — at least in Connecticut.

Lawmakers in Connecticut have introduced a bill that would allow law enforcement agencies to use drones equipped with weapons capable of inflicting deadly force. The proposed legislation has been opposed by civil liberties groups, but is still pending before state lawmakers.

Interestingly, the bill was actually written as a total ban on weaponized drones, however, an exception was added in later to exclude law enforcement agencies from the ban. Theoretically, this would give police departments the authority to use drones outfitted with weapons, which they could ostensibly use to inflict deadly force on citizens.

Civil Liberties Groups Oppose Weaponized Police Drones

Citing research showing that police tend to unfairly target those in minority communities, opposition groups have stated they fear that okaying weaponized drones for police departments will result in an uptick in the misuse of deadly force against minority communities.

The executive director of the American Civil Liberties Union in Connecticut stated, “Data shows that police force is disproportionately used on minority communities, and we believe that armed drones would be used in urban centers and on minority communities.”

Weaponized drones are banned in 36 states, and four states have adopted policies that limit police drones. North Dakota passed legislation allowing weaponized police drones in 2015, however, the drones are limited to “less than lethal” weapons like tear gas, pepper spray, and rubber bullets.

If the bill in Connecticut passes, the state will become the first to allow police drones to include weapons capable of inflicting deadly force. The bill also provides that new policies governing the use of weaponized police drones in the state would have to be developed by the state’s Police Officer Standards and Training Council.

Opponents of Police Drones Say Robots and Drones Depersonalize the Use of Force

Dallas police made headlines in 2016 when they used a robot to exercise deadly force against a suspect in a standoff. Opponents of weaponized police drones say the situation is similar and takes the “human” element out of the decision to exercise deadly force. They argue that allowing a robot or drone to pull the trigger or fire the weapon makes the decision more anonymous and thus far easier to make.

Aviation Accident Lawyer Discusses Air Canada Near Miss

It’s an airline passenger’s worst nightmare: a major airline disaster. According to media reports, an Air Canada jetliner missed crashing into four fully loaded passenger jets, coming within less than 100 feet before abruptly pulling up and completing what is known as a go-around.

Go-arounds are common and occur when an airplane must circle the airport prior to landing, either because the runway is crowded or because air traffic controllers are too busy to give the pilot direction to land the plane. In other words, if something occurs to make conditions “not quite right for landing,” the tower will tell the pilot to do a go-around. If you fly regularly, you might even know exactly when this occurs.

However, it is not normal for a commercial jet to get within 98 feet of other planes and nearly crash into them. This is what happened with the Air Canada flight. According to aviation experts who spoke to the press, if the plane hadn’t safely aborted its landing, it would have been the deadliest aviation accident in history. John Cox, a retired airline pilot, stated, “This was very close to a catastrophic event.”

How Often Do Near Misses Happen?

According to the FAA, near misses like the one that occurred with the Air Canada flight are “rare events.” The plane, an Airbus 320, had 135 passengers on board, along with five crew members, when it approached the runway at San Francisco airport on a scheduled flight from Toronto.

As the plane approached the runway, air traffic controllers noticed that it was headed directly for a taxiway where four other planes were sitting, waiting to takeoff. All four of the jets were fully loaded with passengers and filled with jet fuel. The taxiway in questions runs parallel to the runway the Air Canada plane was supposed to be approaching.

Although investigators are still looking into the incident, preliminary reports indicate that the pilot confused the taxiway for the runway. Audio from the flight reveals the pilot telling the tower that there are lights on the runway. Another voice — assumed to be someone from the tower — says, “Where’s this guy going? He’s on the taxiway?”

The Times reports that the passenger attempted to snap a photo of the airline employee, who was allegedly smiling — something that irritated a long queue of passengers who had just been told their flight was delayed for 14 hours. “The employee swiftly slapped the cellphone to the floor. The [passenger] retaliated, shoving his hand into the attendant’s shoulder and then his face. The attendant, regaining his footing, lunged forward and threw a jab into the man’s face.”

Although no video of the incident has surfaced, several passengers captured photos of the incident, which indeed shows the airline worker with his army fully extended in a lunging position. Several passengers looking on seem shocked and horrified. The photos also clearly show that the passenger was holding a young child in his arms.

Merge Onto The Highway With Caution Urges Boca Car Accident Lawyer Joe Osborne

Technically speaking Florida law doesn’t state which vehicle has the right of way though it states when one vehicle needs to yield to another. Those entering a highway from a secondary road need to yield to vehicles in the travel lanes.

Here are some suggestions on safe merging from AARP:

Prepare for merging while traveling on the on ramp. As you approach the highway look around you, in front of you (someone may be traveling at a slow speed or stopped in front of you), behind and to your right.

Do your best to check your blind spots to make sure you won’t be cutting someone off or colliding into them.

Be wary of motorcycles and take extra caution at night and in bad weather.

Use your turn signal to remind other drivers you want to get onto the highway.

Identify a safe gap that you can merge into.

Speed up to match the speeds of the other vehicles.

Don’t stop before merging unless it’s absolutely necessary.

Yield to highway traffic and move over when it’s safe to do so.

If you need to cross several highway lanes do so one at a time while using your turn signal.

Be aware of the length of the merge lane which can vary greatly.

Once you’re on the highway try to be courteous to drivers entering the highway by moving over if it’s safe to do so. This will make it easier for the other driver and reduce the risk of a collision with you.

Facebook Loses Search Warrant Case Dallas Criminal Defense Lawyer Offers Insight

There is no question that the internet has forever changed privacy rules. Because the pace of technology moves much faster than the law, courts are often challenged to make decisions about how the law applies to internet privacy and constitutional rights.

In a recent New York case, the court ruled against social media giant Facebook over bulk search warrants.

Court Allows Bulk Search Warrants

In April 2017, the New York Court of Appeals ruled 5 to 1 that it lacked jurisdiction to decide Facebook’s appeal of warrants obtained by the Manhattan district attorney’s office.

According to a Reuters report, “the decision is a defeat for internet privacy advocates.”

The case began in 2013, when prosecutors sought and received warrants ordering Facebook to hand over account information for hundreds of individuals suspected of engaging in disability benefits fraud. Several of the account holders targeted were retired police and firefighters suspected of faking sickness related to the September 11, 2001 World Trade Center attacks.

Facebook initially resisted the warrants, claiming they were overly broad, but eventually gave in when prosecutors threatened to hold the company in criminal contempt.

While Facebook complied with the warrants, it also appealed them on privacy grounds. In addition to claiming that the warrants were overly broad, Facebook also objected to the gag order that accompanied the warrants and prevented the social media company from notifying affected users that their account information was being turned over to law enforcement.

New York Court Says It Can’t Rule on the Merits of Facebook’s Appeal

The New York court ruled that Facebook didn’t have legal standing to challenge the warrants. Instead, the court ruled, it is up to the individual account holders to challenge the legality of the warrants.

Although the judge writing for the majority opinion stated that the case “undoubtedly implicates novel and important substantive issues regarding the constitutional rights of privacy and freedom from unreasonable search and seizure, and the parameters of a federal statute establishing methods by which the government may obtain certain types of information,” the court claimed it was bound by law and thus lacked the authority to rule on Facebook’s claims.

Civil Rights Groups Claim Internet Search Warrants Are “Fishing Expeditions”

Internet privacy advocates and civil rights groups stated they were disappointed with the court’s refusal to rule on the merits of the case. The New York Civil Liberties Union called the warrants a “fishing expedition” that was overly broad and a clear violation of Facebook users’ privacy rights.

Uber Knowingly Leased Cars With A Fire Risk

According to reports from The Wall Street Journal and NPR, popular ridesharing service Uber leased vehicles to customers even though it knew the vehicles contained a defect that could lead to an electrical fire. Reports state that Uber purchased over 1,000 Honda models in April 2016 — all of which were defective. Despite knowing about the potential for a serious or deadly fire, Uber reportedly leased them to customers anyway. In turn, these customers worked as Uber drivers, transporting passengers.  

NPR reports that one man had just dropped off a passenger in January 2017 when the Honda he was driving began to smell like smoke and “spouted flames from its dashboard…melting the car’s interior and cracking its windshield.”

Emails Show Uber Knew Cars Were Defective

The Wall Street Journal also reports that a review of internal Uber emails and documents reveals that the company knew the Honda vehicles were defective but “continued to lease them to drivers unfixed.” Furthermore, reporting states that Uber executives knew the cars had been recalled but failed to take them off the road.

Uber first expanded into the Asian market in 2013, launching in Singapore. Because government rules require individuals in Singapore to purchase a “certificate of entitlement” giving them the right to own a car for 10 years, few people can afford to own a vehicle. As a result, Uber has been a big hit in the region. Uber has apparently taken advantage of the area’s low car ownership by leasing vehicles to drivers who wish to work for Uber. NPR reports, “It represented a new approach for the company, which avoids owning assets.”

NPR also reports that Uber bypassed purchasing vehicles from authorized dealers and instead chose to import cars from smaller dealers working within a so-called “gray market.” An NPR report goes on to state that safety rules in the gray market are more difficult to enforce.

An Uber spokesperson told NPR that the company took action after learning of the fire but “could have done more.” However, reporting states that Uber executives at the company’s headquarters in San Francisco were made aware of the January 2017 fire in Singapore and decided to deactivate the component associated with the fire risk and “leave the cars on the road to wait for replacements.”
