Sex charges are typically arranged in three tiers, which the Founding Partner of the Law Offices of Edward R. La Rue outlined below. Tier 3 crimes are considered the most serious, while Tier 1 is regarded as the least ‘severe’.

“All sex crimes are serious, and anyone alleged to have committed one should urgently reach out to a criminal defense attorney who specializes in that field to benefit from their professional expertise,” he commented.

Tier III: Offenses cover rape, sexual battery, aggravated murder with sexual motivation, certain gross sexual imposition offenses with a minor, kidnapping with sexual motivation and the victim is a minor, etc.

Tier II: These include child endangering, kidnapping with sexual motivation, compelling prostitution, pandering obscenity involving a minor, unlawful sexual contact involving a minor, or any sexual offense occurring after the offender is classified as a Tier I sex offender.

Tier I: Charges can include unlawful sexual conduct with a minor when the parties are less than 4 years apart in age, importuning, voyeurism, sexual imposition, child enticement with sexual motivation, and illegal use of a minor in nudity-oriented material, etc.

Mr. La Rue acknowledged that the legal age for sexual consent in Ohio is sixteen. But, even if a teen and older person claim they are both willing participants in the sexual encounter, it still may have serious consequences under the law in some situations.

Ohio divides sexual assaults into two categories, “sexual conduct” and “sexual contact”.
“Sexual conduct” is defined as vaginal and/or anal intercourse, fellatio, and cunnilingus, with any penetration, however slight, being sufficient for intercourse to be considered to have been completed. ORC 2907.01. “Sexual contact” is defined as any touching of an erogenous zone of another, including without limitation, the thigh, genitals, buttock, pubic region, or if the person is a female, a breast, for the purpose of sexually arousing or gratifying either person. ORC 2907.01.

Rape and sexual battery offenses apply when the “sexual conduct” is committed without the victim’s consent or through force, the threat of force, intimidation, coercion, impairment, disability, or because the victim is under thirteen and therefore, under the law, is recognized as being incapable of giving consent to be involved in sexual activity. 

Gross sexual imposition and sexual imposition are offenses that are charged when the “sexual contact” is either compelled by force or threat of force, the victim is substantially intoxicated or impaired by mental or physical disability, or is under thirteen and therefore is incapable of consent.

Each of the three tiers carries a range of sentencing powers and varying registration conditions. 

For example, a Tier III offender must register every 90 days for the rest of their lives; a Tier II offender re-registers every 180 days for 25 years, and a Tier I offender must re-register once a year for 15 years (though that can be reduced to 10 years by the trial court upon motion).

Mr. La Rue concluded that being charged with a sexual offense can have serious repercussions on a person’s life, so the need to act swiftly to hire an attorney with the knowledge and experience to defend against such heinous allegations is critical so the attorney can fight for you from the start, develop a plan of defense, and try to mitigate any potential damage to reputation, loss of a job or housing, etc.

The Property Advocates Successfully Argue in Court of Appeals for Reversal of Summary Judgment

The Property Advocates successfully represented a Florida homeowner in a case against an insurance company that tried to deny his claim for coverage of damage sustained due to a water leak.

Florida’s Fifth District Court of Appeals ultimately ruled in favor of Mr. Saavedra, a homeowner who sued Universal Property & Casualty Insurance Company after the company failed to honor its contractual obligation to pay for damages to his home.

The case, Saavedra v. Universal Property & Insurance Company (Case Number 5D19-2176 in the Florida Fifth District Court of Appeals) was ruled on February 19, 2021.

Universal denied and requested summary judgment based on their claims that Mr. Saavedra didn’t comply with the conditions precedent to his lawsuit since he didn’t report the loss in a timely fashion, show the insurance company the damage to his property or provide records to the company.

The Property Advocates, representing Mr. Saavedra in the case, argued summary judgment couldn’t be based on the defenses Universal was putting forward because they hadn’t specifically included the issues in its Answer and Affirmative Defenses, which Florida civil code requires them to do.

The trial court, though, rejected the arguments The Property Advocates put forward, granting summary judgment to Universal as a result.

The Property Advocates appealed this decision to the Fifth District Court of Appeals. That court confirmed The Property Advocates were correct in their interpretation of Florida law when they said that Universal had waived its defense of compliance with conditions precedent.

This happened because Universal, in its Answer, in this case, didn’t “identify the nature of the conditions precedent or the nature of non-compliance, such as the specific post-loss duties with which Saavedra failed to comply, or where exactly in the policy such conditions could be found.”

In making its ruling, the Fifth District ruled that “Universal failed to comply with the requirements of rule 1.120(c), thereby waiving its defense that Saavedra failed to comply with condition precedent.”

Since the trial court’s ruling was based solely on the premise that Mr. Saavedra didn’t satisfy the conditions precedent, the Fifth District court reversed the summary judgment. As a result, the Fifth District then remanded the matter back to the lower court for further proceedings.

The Property Advocates correctly interpreted Florida law to ensure that their client in the case, Mr. Saavedra, was provided what he deserves in regard to his homeowner’s insurance coverage.

He said: “The first tip is not to rely on hearsay and ‘helpful advice’ from loved ones and friends. Get professional advice from an Estate Plan/Elder Law attorney, a financial professional, a tax professional, and an accountant so you can build an estate plan that reflects your needs.”

Newborn said one area often overlooked is digital assets – images and documents stored on social media or ‘in the cloud’. “Assign all your login names and passwords to a trusted person close to you, so they can gain access and be able to shut down your online presence.”

He emphasized: “A plan should be created before you become incapacitated or too sick to do so. This includes, among other things, planning for taxes due within nine months of death. Putting money away for that tax day may prevent assets you wanted to allocate to loved ones from being sold off.” An estate planning attorney can clarify these further. 

Planning can also be beneficial if long-term care needs have to be factored in. Speak to a financial advisor and Elder Law attorney to discuss all these options and the little-known issue of the Income in Respect of a Decedent, or IRD. 

He said: “If you die and have income, such as savings bond income and individual retirement account payouts that haven’t been taxed, your estate will have to foot the bill.”

Finally, review your estate plans at least once a year and keep beneficiaries updated to prevent potential conflicts after death. “To be effective, a plan should be reviewed and updated every 3 to 5 years at the very least to reflect changing circumstances in life, income, and family,” he concluded.

Mr Casey revealed: “A will is not a secret to be held by the personal representative. Unless documents state otherwise, beneficiaries requesting a copy of the will should receive the entirety of the document.”

Failing to handle tax debts or liabilities is another area where personal representatives and trustees can fail. “Some tax issues will arise, such as having to file the person’s last income tax return,” he said. 

“Debts that are negotiated less than the original amount owed could also trigger a tax inquiry.” Additionally, significant gifting before death can generate extra scrutiny.

Mr Casey also flagged managers’ desire to pay beneficiaries before settling debts. “Debts need to be paid first and then beneficiaries. Failing that, litigation could be taken against the fiduciary if insufficient money is left to meet those taxes and debts.”

To avoid wrongdoing, a personal representative or trustee should be adept at meeting debts, and deadlines, communicating key events and being transparent in the accounting of the estate. 

He concluded: “A fiduciary should seek professional advice from a specialist attorney if they believe they are failing in their duties, simply guessing their way through the process, or don’t clearly understand their responsibilities.”

One strategy, according to Brumfield, is to map out a loved one’s medical wishes. Healthcare directives can significantly ease your and your loved one’s stresses, particularly during medical emergencies.

A living will, also known as an Advanced Directive, can make explicit certain end-of-life decisions, significantly lifting a loved one’s burden in making that call.

Brumfield, P.C: “Only after someone’s primary physician signs off they’re unable to make decisions on their own does a living will take effect. Brumfield advised that a Do Not Resuscitate (DNR) Form should be aligned to a Living Will. A DNR order informs a health care professional not to administer CPR through certain drugs, artificial breath tubes, chest compressions, or a defibrillator if a patient’s heart stops or if they stop breathing. 

The DNR is something that is signed by the person’s physician and posted in a conspicuous place in the person’s home. “It’s also important to inform family and friends of a DNR order so they can notify medical professionals in an emergency.”

A Medical (or Health Care) Power of Attorney is another vital component of healthcare directives. Brumfield elaborated: “This allows the person making the document to assign a trusted individual, or agent, to make medical decisions on their behalf after they are deemed unable to do so. This encompasses all healthcare-related decisions, so the person entrusted to this role must be comfortable carrying out medical wishes.”

The agent, acting under a Medical (or Health Care) Power of Attorney, has the authority to execute specified health care wishes in Court, decide on the hiring and firing of doctors and other medical professional workers dealing with treatments, and access to medical records if the document is properly drafted with the appropriate HIPAA language.
