Canyon Enters into Limited Forbearance Agreement with Falcon Gold Inc.

VANCOUVER, BC / ACCESSWIRE / August 31, 2015 / Canyon Copper Corp. (TSXV: CNC) (“Canyon”) announces that it has entered into a limited forbearance agreement (the “Agreement”) with Falcon Gold Corp. (“Falcon”) in connection with the late payment of the 2016 Bureau of Land Management fees (“2016 BLM Fee”), the 2015 annual lease payment of $30,000 on the patented claims (the “2015 Lease Payment”) and the 2015 option payment of $20,000 (the “2015 Option Payment”) due under the option agreement with Falcon (the “Option Agreement”). Under the terms of the Agreement, Canyon has agreed not to exercise its rights to terminate the Option Agreement with Falcon as a result of Falcon’s failure to pay the 2016 BLM Fee, the 2015 Lease Payment or the 2015 Cash Option Payment provided that Falcon:

(a) issues and delivers to Canyon the 750,000 common shares of Falcon issuable to Canyon as the first and second anniversary share issuances under the Option Agreement;

(c) pays to Canyon the 2015 Cash Option Payment and the 2015 Lease Payment on or before September 30, 2015;

Testosterone Lawsuit Update: Bellwether Case Selection Process Being Disputed in AndroGel MDL

August 31, 2015 – – Banville Law reports on an update in the pending testosterone litigation involving AbbVie, Auxilium, Pfizer and other pharmaceutical companies.

Nearly 2,000 lawsuits have been filed in relation to allegedly dangerous side effects of testosterone replacement therapy (TRT) supplements since the Multidistrict Litigation (MDL) was established in the US District Court for the Northern District of Illinois.

The first bellwether trial is scheduled to begin on October 1st, 2016 and several other trials are scheduled to commence shortly thereafter. However, while the dates of the initial trials have been set, the specific cases that will be tried have not been chosen yet.

Parties from both sides of the litigation discussed the selection process for the bellwether cases in a recent status meeting held on August 14th. According to official minutes from the status conference, defendant AbbVie (maker of AndroGel) proposed that the court select 32 cases for discovery. After the discovery process is complete, AbbVie proposes that plaintiffs and defendants then agree on six cases (from the pool of 32) to go to trial.

Conversely, plaintiffs proposed that both sides of the litigation submit a list of 16 potential cases for selection and that the court choose six cases for the bellwether trials.

In the first quarter of 2012 there were 130,000 prescriptions for Xarelto issued in the United States. EvaluatePharma has estimated in its World Preview that if these sales continue at this rate, Xarelto will become the 19th best selling drug in the world and by 2018 will generate 3.7 billion U.S. dollars in sales, a huge increase from the $596 million in sales the drug generated in 2012. These sales can be attributed to Xarelto’s intense marketing and also because of the cost of Xarelto in general. A one year’s supply of Xarelto costs $3,000, a steep cost compared to a one year supply of Warfarin, which only costs $200.

A growing number of lawsuits have been filed across the country alleging that Xarelto caused internal bleeding injuries and death. These lawsuits also allege that Xarelto’s manufacturers concealed information from doctors and patients about the real dangers of Xarelto, especially concerning the fact that Xarelto does not have a reversal antidote. The lawsuits that have recently been filed also highlight the market share that Xarelto has captured because of the promotional techniques used.

Trials in the Xarelto lawsuits have not begun, so there has not been a Xarelto lawsuit settlement yet. The cases in the MDL and the Philadelphia Mass Tort Group are being filed individually, so it is very difficult to estimate how much any case will settle for because the circumstances of these lawsuits vary greatly from case to case.

Each lawsuit filed will list a variety of economic and non-economic damages that the plaintiffs allege Xarelto was the cause of. Examples of economic damages include treatment costs, medical expenses, long term or future care, funeral or burial expenses, and loss of wages or future income due. Non-economic damages are things such as the pain and suffering for the injuries caused, or the pain and suffering caused by losing a loved one.

While we are unable to estimate how much any Xarelto lawsuit settled for, we can look to past litigation for a general idea. Recently, lawsuits were filed against a blood thinner similar to Xarelto, Pradaxa. These lawsuits settled in May 2014 and the drug’s manufacturer, Boehringer Ingelheim, settled 4,000 lawsuits against Pradaxa for $650 million.

Xarelto Lawsuits Filed in MDL and Mass Tort Group:

As of May 2015, more than 400 federal lawsuits filed against Xarelto have been transferred to the multidistrict litigation, MDL, set up in the Eastern Judicial District of Louisiana . There are also more than 100 lawsuits filed in a mass tort group in Philadelphia, PA. Both of these legal systems are set up specifically to handle claims from individuals and families who all make similar allegations regarding Xarelto against Bayer AG and Johnson&Johnson.
